Mr. Sjodin stated that he has a party who wants to build on the lot. Attorney Meyers replied that approval tonight would force the Council to make a decision on granting variances for 772' lots and that the undue hardship has not been proven. Councilmember Ziebarth questioned if the road does not go through if variances could be granted for the two lots due to economics. Attorney Meyers replied that the variances could be granted but that that was not the type of hardship the courts were looking for. Administrator Achen pointed out that this is entirely an economics situation since the builder stands to benefit much more by having two 772' lots rather than one 95' lot. Mr. Sjodin stated that he had asked the Building Official if he could put another house where he tore the old one down and was told he couldn't. Attorney Meyers replied that he was not sure of all the facts behind the case but that usually if there is an 85' lot with all conditions being equal, a building permit must be issued. PARKS AND RECREATION - SOFTBALL TOURNAMENT POLICY Park Director Anderson explained that the policy came about due to numerous requests for softball tournaments in Mounds View, and there are stipulations are included in the policy, that only Mounds View sanctioned teams could conduct tournaments in Mounds View, that a 3.2 beer concession permit could be issued for $50 per weekend, and the games could start at 12 noon on Sundays. Park Director Anderson stated that he had conducted a survey of 20 municipalities to see how they handled their tournaments and that 14 communities had responded. He also stated that he had contacted the Chief of Police to see if he had any problems with the tournaments being held, and that he didn't. Park Director Anderson stated that he did not believe there was any right way or wrong want to set the policy and that each community had to set their own standards. Councilmember Baumgartner asked what the liability was for the City on the 3.2 beer concession permit. Park Director Anderson replied that the sponsor of the tournament would be required to have the proper coverage and would assume all liability. Councilmember Baumgartner asked if the tournaments could become an every weekend event. Park Director Anderson replied that they would not as Staff would be controlling it. He added that he has already received three or four requests for this summer. Councilmember Ziebarth recommended that final decisions should rest with the Park and Rec Director and recommended that it be stated as such in the policy. Councilmember Rowley questioned if the teams are allowed two tournaments per season if the City could refuse to issue a permit for the second tournament if problems are experienced at the first. Park Director Anderson replied that they could refuse since Staff would have the final say in the matter. Councilmember Baumgartner stated that he was uncomfortable with the City selling 3.2 beer concession permits for the tournaments.
