Mayor Pickar stated he would like to withdraw his previous motion. Councilmember
Ziebarth agreed to withdraw his second of that motion.
MSP (Pickar- Ziebarth) to ask Ramsey County Soil and Water Conservation District to
evaluate the property and get an answer back to the City and continue the hearing
until July 24 at 7:40 PM, and specifically ask Ramsey County about the property
involved. 4 ayes
Mayor Pickar recessed the hearing and opened the next public hearing.
DAILEY KNOLL'S - PRELIMINARY PLAT AND REZONING
Administrator Achen recommended that the hearing be continued until July 24 also
since it was directly related to the previous public hearing on Project 1978 -6.
Mr. Thornson, the developer, agreed to the continuation.
Mayor Pickar stated that the Dailey Knoll's public hearing would be rescheduled
for July 24, 1978 at 8 :10 PM.
Mayor Pickar closed the public hearing and reopened the regular meeting.
KEN SJODIN MINOR SUBDIVISION REQUEST - SINGLE FAMILY RESIDENTIAL DEVELOPMENT
Attorney Meyers reported that he had been requested to review the variance request
of Ken Sjodin. Attorney Meyers read his memo to the Council, summarizing his
research on the issue of granting variances. Attorney Meyers explained that the
problem with the property in question is that the lot is 155' wide, which is a
buildable lot, although it would not be economically feasible to put just one
house on a lot that size, while if the lot were split into two 772' lots, they
would be substandard and would require a variance.
Mr. Sjodin pointed out that there have been several instances where the City has
granted variances in the past. Attorney Meyers replied that each time a variance
has been considered, he has reminded the Council that a hardship must be proven.
Councilmember Baumgartner pointed out that several years ago the City converted
from 75' lots to 85' lots, and that many which have since been granted could have
been subdivided before the City changed the lot size requirement.
Mayor Pickar stated that at the last meeting he had requested Mr. Sjodin to check
with the rest of the neighborhood for their feelings about extending Knollwood.
Mr. Sjodin replied that he had not checked as he had stated that he would do so
only after the subdivision was approved.
Councilmember Baumgartner stated he felt it was very important to know where the
road was going to go before the lot was split. Mr. Sjodin replied that he did not
feel the road had anything to do with granting the variance.
Administrator Achen expressed concern with the road alignment and stated that the
Police Department does not want off -set intersections. Mr. Sjodin replied that
there would not be any problem with an off -set intersection. He also added that
he could build directly in the middle of the 155' lot and thus block the way for
the road to go through at all.
