Mr. Thorson stated that he believed the Council had previously said they would approve
the plat if he added on the 32', which would make the lots less than 1' short of the
required frontage. He pointed out that the lots are extremely deep, and square footage
wise were almost double of what was required. He added that he could take the extra
footage from the lot he had bought in order to make three 100' lots.
Councilmember Baumgartner replied that he did not recall the Council ever saying they
would definitely approve the plat with the 32' added on.
Administrator Achen stated that the best thing to do would be go back to the Planning
Commission with a redrawing of the preliminary plat since there is an obvious question
of what will happen with the additional lot.
Attorney Meyers asked if the title to the property had been transferred yet. Mr. Thorson
replied that it hadn't as he was waiting for Council approval before finalizing the
purchase of the additional lot.
Attorney Meyers asked if the additional 32' was included in the notice of the rezoning
hearing. Administrator Achen replied that it most likely had not.
Councilmember Rowley stated she felt the Planning Commission should address the request
again before the Council takes any action.
MSP ( Pickar- Ziebarth) to direct Dailey Knolls, Mr. Thorson, back to the Planning
Commission and direct that the Clerk- Administrator prepare a list for the Planning
Commission of the points they should take into consideration. 5 ayes
Councilmember Baumgartner asked if Mr. Gillman should be notified of that action.
Attorney Meyers replied that he would have to sign the application for the rezoning.
Mayor Pickar closed the public hearing and reopened the regular meeting.
WHITE OAK HOMEOWNERS ASSOCIATION - SILT REMOVAL FROM PONDING AREA
Mayor Pickar reported that the White Oak Homeowners Association has initiated a request
to the Council to use Random Park as a temporary holding area for the silt from their
ponding area. He added that Staff and the Park Commission have reviewed the request
and recommend that the Silver View Park site would work out better than Random Park.
Tom Foster, president of the White Oak Homeowners Association, stated that he was still
in the process of having the DNR and Rice Creek Watershed District review the request
and that they have run into a problem with the Watershed District as the first meeting
they could consider the request is on December 27, and that they had not anticipated
such a lengthy delay. He added that he was also concerned with the ice setting in on
the lake. Mr. Foster stated he had spoken to Roto Rooter, who would be doing the work,
and that they would prefer waiting until Spring to do it, and that they had promised
this project would be first on their list for Spring.
Mayor Pickar asked if the delay until Spring would create any problems for the Homeowners
Association. Mr. Foster replied that it would not.
Councilmember Ziebarth stated that the primary concern of the Park Commission was to
accomodate the Homeowners Association, as Fall is a better time for this type of work
as it is dry. He added that they now have a suitable site but have a timing problem
with all the agencies involved.
