Councilmember Rowley stated that as long as the project was not going to be done this
Fall, the water table should be checked in the Spring before final approval is given.
She added that the Homeowners Association should go ahead and get approval from all
the agencies involved and then come back in the Spring for final approval from the City.
Councilmember Ziebarth asked if permission had been received from all the affected
property owners. Mr. Foster replied that he was still working on that.
Councilmember Ziebarth recommended that Staff's recommendations be added to the agreement,
such a feasibility report with the amount of time, the volume of material and permission
from the affected property owners.
Councilmember Rowley asked if Staff saw any problem with the work waiting until Spring.
Park Director Anderson replied that only problem he could see was if the project was
delayed until April or May, which would delay the planned work on Silver View Park.
He added though, that the Homeowners Association wanted the work done as quickly as
possible also.
Councilmember Baumgartner asked if one of the federal agencies would actually be going
out and examining the sludge for pollutants and so forth. He added that he was
concerned there might be a high concentration of pollutants in the lake from chemicals
that had washed down off the lawns.
Mr. Foster replied that there is a constant flow of water out of the lake. Administrator
Achen added that the City can request the agencies do that when they consider the request.
Councilmember Ziebarth stated that as long as it had been agreed to wait until Spring
to do the work, he would like to discuss the project further in an agenda session to
work out the details.
MSP ( Pickar- Ziebarth) to postpone action on the request until the second meeting in

FILL PERMIT - 2296 -2288 PINEWOOD DRIVE
Mayor Pickar reported that the two properties involved, 2296 and 2288 Pinewood Drive,
have extremely low back yards and that the owners have requested approval to fill
their rear lots to prevent water from going in their walkout basements when the storm
sewer backs up.
Larry Aamot, 2296 Pinewood Drive, stated he and his neighbor had had an engineer come
out and study the problem, and that he had determined they had a surface water problem.
He stated they would like to fill their back yards to prevent the water from coming in
their homes when the storm sewer backs up. He added that they both have walkouts, which
would be bricked up, and that based upon Staff's recommendation, they would be going
with a 2% slope.
Councilmember Baumgartner stated that the request had been discussed and approved by
the Planning Commission. He added that the rear yards will still be holding areas.
MSP (Hodges - Ziebarth) to accept the Planning Commission's recommendation to approve
the fill plan as presented, maintaining a 2% slope from the homes to the culvert,
and to waive the $50 Conditional Use Permit fee. 5 ayes
