anything over that. She also stated that she had a real problem with
having a building on an easement and with an uneven lot split.
MSD (Rowley - Ziebarth) to approve an equal lot split with the accessory
building size reduced to conform to code, that when it is reduced, the
garage door will be removed so in appearance it will be an accessory
building and not a garage, and the building be no closer than the
allowable setback, maintaining the 5' rear yard setback and the 5'
easement be maintained, and the chicken coup to be removed.
A rollcall vote was taken:

Councilmember Hodges - nay
Councilmember Forslund - nay
Councilmember Rowley - aye
Mayor McCarty - nay

Councilmember Ziebarth stated that he felt an uneven lot split could
create problems in the future. He added that the garage as it is now
presents no problems unless the owner wants to subdivide, which he
has requested now, so he should be required to meet code.
Official Rose pointed out that the applicant will be in violation when
he comes in for a building permit if the proposed home has a double
garage.
Jerry Linke, 2219 Knoll Drive stated that a precedence has been set on
the block for equal lot splits and that if the applicant was required
to take out the large garage door, he could just as easily continue on
and cut it down to size on that end and meet code.
MSP (McCarty - Ziebarth) to reconsider the previous motion. 5 ayes
MSP (McCarty- Rowley) to have an equal lot split, with the building being
reduced to conform to code, the garage door be removed, the chicken
coup be removed, and the 5' easements be maintained.

Mr. Kremer explained that his parents own two lots which they would like
to develop, and which require services, and presented their proposed plan.

at the time the building permit was issued for the proposed duplexes,
