Ziebarth made the motion, seconded by Hodges
that Staff should prepare a development con-
tract with Faircon, Inc., contingent on PCA
approval. Staff should also determine and
collect the appropriate consultant fees
related to the City's expenditures.

Rose explained that Phillips Javinski proposes
to build an office /warehouse on Lot #1 of M.V.
Industrial Park #3. (The details of this
proposal may be found in the Summary prepared
by Staff under Case #39 -79.) Planning Commission
approved this proposal.
Forslund made the motion, seconded by Hodges,
to approve the development request contingent
upon receiving the necessary PCA approval.
Staff is directed to draw up a development
agreement, and establish and collect the
necessary fees needed for consultants, pursuant
to Ordinance 59.07.

Project 1979 -3 for sewer and water along
Silver Lake Road was ordered by City Council
on 5/29/79. Improvements were to be installed
pursuant to Alterate 2 of the feasibility study
ordered at the 5/14/79 meeting. Soil tests,
done by Short - Elliot- Hendrickson, revealed
bad soil conditions. On 7/23/79 the Council
approved additional soil tests. Those tests
indicated the soil had limitations but the
services could be installed. Council requested
S.E.H. on 9/10/79 to determine if the private/
public service proposals were feasible. S.E.H.
have suggested they do a new feasibility study.
Some of the residents needing water service
propose to dig wells until service is available.
Forslund made the motion, seconded by Ziebarth,
to direct Staff to contact Mr. Thorson regarding
his private proposal; and to request the
appropriate owners north of County Road I
to prepare a petition for services. After
Staff has reviewed this petition, a report
should be prepared for Council.
