up -date, Comprehensive Park Plan, and to
satisfy the requirements of the Federal
Flood Insurance. There were no questions
asked by the public. Nelson explained the
funding of this survey work. Ziebarth
moved the adoption of Resolution 1070 Con-
tract for Services by Mark Hurd Aerial
Surveyors, Inc., to provide the City with
aerial photographs, rectify half - section
map and 2 foot contours of the City.
Forslund seconded the motion.

At this point the Acting Mayor noted that 8. CODE AMENDMENT 40.06
a public hearing was scheduled at 8:40
and suggested to the Council that the pub-
lic hearing be called to order. Acting
Mayor Hodges called the meeting to order
at 7:55 for the purposes of having the
first reading of the proposed amendment
to the City's Chapter 40 of the Municipal
Code. Nelson explained that under the pro-
visions of the charter that no amendment
or ordinance could be adopted except for
emergency ones without having at least two
readings before the public and 14 days be-
tween the two Council Meetings before appro-
val. The City Attorney said that because
this particular code that was Land Use, a
public hearing was mandatory under the
Minn. Statute 462. Nelson read the proposed
amendments to the public of Chapter 40
Municipal Code. There were several concerns
expressed by the public over the potential
impact of this proposal. Primarily, this
