After hearing the reasons behind the suggestions, the City Attorney felt that the language did not contribute to the clarifications of that section. The Attorney stated that the suggested language proposed to go back to the original language submitted to the City Council by the Attorney. After much deliberation by the Council, with comments from the public, it became apparent that the original language would be substituted and incorporated into the final document. Rowley moved adoption of Chapter 26 with the amended language found in the Proposed Ordnance No. 26 in Sub - Division 26.09 to read as follows: The City may subsequently reimburse itself for all or any of the portion of the cost of a water, storm sewer, or sanitary sewer improvement so paid by levying additional assessments upon any properties abutting on but not previously assessed for the improvement, on notice and hearing as provided for assessments initially made. Forslund seconded the motion. McCarty moved to amend the motion by adding the following language at the end of 26.09: The provisions of 26.09 shall apply to such extensions or improvements in the same manner as if they were new improvements. It was seconded by Ziebarth. The Mayor called for the question. 5 ayes Amendment Carried. 0 nays The main motion was called for and a voiced roll -call vote was taken. Mayor McCarty aye Councilman Ziebarth aye Councilman Hodges aye Councilman Rowley aye Councilman Forslund aye The Council thus adopted Ordinance 95 /Chapter 26 of the Municipal Code. Nelson stated that due to the language amendment the Council adopted the Ordnance would not appear in the upcoming addition of the New Brighton Bulletin.
