Mr. Rod Kelsey was present also. Mayor McCarty and
the other Council members complimented Mr. Kelsey's
efforts in this program.
MOTION: Rowley made a motion, seconded by Hodges,
to accept and adopt the Stanton & Associates salary
administration and performance review program as
presented to them this evening.

Mayor McCarty asked to have Item #F removed for 6. APPROVAL OF CONSENT AGENDA
discussion.
MOTION: Hodges made a motion, seconded by Ziebarth,
to approve the consent agenda ( minus Item #F)
and to waive the readings of the resolutions°

Nays -0

DISCUSSION ON ITEM #F
(1980 Audit Proposal)
Mayor McCarty asked to have the wording of Item #F
read "Receive" instead of "Accept" George M. Hanson
Company's proposal for the 1980 Audit.
MOTION: McCarty made a motion, seconded by Ziebarth,
to change "accept" to "receive" on Item #F (re: the
George M. Hanson Company's proposal for 1980 Audit)
Ayes -5
Nays -0
MOTION CARRIED.
The Council also noted that they wished to have the City
review other bids at a future date.
Upon receiving a request from the Planning Commission 7. James Odle- Variance Request
and City Council, Attorney Meyers searched the existing 8070 Red Oak Drive
city codes to determine the enforceability of the 5' Case 63 -80
driveway set back. Upon investigating this issue,
Attorney Meyers determined that this set back require-
ment is enforceable under the existing city codes.
He also noted that the City's Building Official could
not issue a building permit for the construction of a
concrete or asphalt driveway within the defined side
yard set backs unless a valid variance was granted by
the Planning Commission or, upon appeal, to the Council.
Attorney Meyers read a memo (dated October 14, 1980) written
by himself to the City of Mounds View indicating the various
applicable existing city codes regarding this 5' setback
requirement. He also attached copies of legal opinions.
