MOTION: McCarty made a motion, seconded by
Hodges to adopt Resolution 1184 with the stip-
ulation that before staff issues a final certi-
ficate of occupancy, the developer provide the
City easement to the holding pond and a $400
bond to be held for the life of the 7 year
maintenance and performance security contract.

MOTION CARRIES.
MOTION: Hodges made a motion, seconded by
Ziebarth to adopt Resolution 1185 (authorization
for final release of cash escrow for Development
AGreement 80 -34) less the expenses that the
City has incurred through the process of develop-
ment.

The Council recessed at 9:20 P.M.
The Council resumed their meeting at 9:47 P0M,
Attorney Meyers noted the Land Use Control series
being offered by the University of Minnesota
Agriculture Extension Office. (Forslund also noted
at this time that the Planning Commission should
regularly receive notices of these types of offerings).

She noted some soil erosion taking place at the site
of Industrial Park #3. Administrator Pauley

Rowley:
The Association of Metropolitan Municipalities will be
meeting to vote on the issue of the 1981 legislative oolicies_
as proposed.
Ziebarth: He would like to get together with the Planning
Commission to determine policies on issuances of variances
so that some clear guidelines and consistency could be
established° This item will be addressed at the next agenda
session of the Council.
