Article 4. He discussed the renegotiating
of the Contract. He discussed the need for a
Joint Powers Agreement.
MOTION: Councilmember Hodges made a motion,
seconded by Councilmember Blanchard to accept
the Contract - Draft #3.
Discussion of the Motion:
Forslund: Cannot support because the Council had
agreed and had submitted Draft #5.
McCarty: He also could not support Draft #3.
Doty: Also could not support Draft #3.
Discussion in length took place regarding the
obligation of the City to levy monies and also
regarding a continuity clause for re- negotiating
the Contract.
Article 6, Duty of Care, was discussed. Mayor
McCarty stated that he would like to take a one
year Contract. Councilmember Forslund concurred.
Vote was taken by calling of the roll.
Ayes -2
Nays -3 (Mayor McCarty, and Councilmembers Doty,
and Forslund voted nay).
MOTION FAILED.
MOTION: Mayor McCarty made a motion, seconded by Councilmember
Forslund to authorize the Mayor and Clerk /Administrator
Pauley to meet with the Fire Deparment Negotiating
Committee and attempt to resolve the concerns that
the City Council has.
Ayes -5
Nays -0 MOTION CARRIED.
Clerk /Administrator Pauley stated that the low
bid from Allied Blacktop Company exceeds the
amount budgeted by $2,836.03. He talked about the
Federal Revenue Sharing guidelines which allows the
cost for budgeted items to exceed the amount
budgeted by 10 %.
MOTION: Councilmember Doty made a motion, seconded
by Councilmember Hodges to authorize the Mayor to
enter into an agreement with Allied Blacktop Company
for the bid amount of $41,436,03.
Ayes -5
Nays -0 MOTION CARRIED,
