Call to Order. MEMBERS PRESENT: Councilmembers Blanchard, 2. Roll Call. Doty, Forslund, Hodges, and Mayor McCarty. ALSO PRESENT: City Attorney Meyers, Clerk/ Administrator Pauley, Parks /Recreation and Forestry Director Anderson and Police Officer Tim Smith. REGULAR MEETING CLOSED: 7:32 p.m. PUBLIC HEARING OPENED: 7:32 p.m. Mr. and Mrs. Chilinski and their Attorney, 3. Public Hearing - Variance William Ekstrum, were in attendance. Request (Sideyard Setbck) Mrs. Chilinski stated that they feel this var- 5242 Red Oak Drive iance request for their addition is a hardship, that it was not due to their fault. She stated that there is also a drain in the back of the property and a sewer easement in the back. Also, that the house next door is only 5 feet from their property line. She talked about the build- ing inspector being out. She has submitted a petition from all of the abutting residents. She talked about a variance that had been granted along Long Lake Road. Further, they are not creating any dangers for public safety. She stated that they feel that their proposed addition would not diminish property values, that it would improve the neighborhood. William Ekstrum, Attorney -at -Law, asked for a show of hands on which neighboring residents were in attendance for this hearing. There were five. Mayor McCarty stated that the petition is not valid unless the Ordinance allows for the petition to be brought in. Mayor McCarty discussed variances issued by the Supreme Court. He read the definition of hardships and unique circumstances that are not due to an act of their own. Discussion took place regarding hardships and unique circumstances. Lyle Lindgren, 5236 Red Oak Drive, stated that he is a neighbor whose property abuts the side where the addition is being constructed. He stated that
