he has no problem with the construction of the
addition. He further stated that there are no
windows on his side of the house that faces the
new addition. Mr. Chilinski stated the petition
was brought in to indicate to the Council that
the neighbors did not disagree with the const-
ruction of the addition.
PUBLIC HEARING CLOSED: 7:39 p.m.
REGULAR MEETING OPENED: 7:39 p.m.
MOTION: Councilmember Hodges made a motion,
seconded by Councilmember Doty to approve the
Variance for the sideyard setback at 5242 Red
Oak Drive.
Discussion of the Motion:
Hodges: He feels that the hardship was caused by
circumstances that were beyond their control.
Also, that the construction was taken too far
before it was stopped.
Doty: He feels that there are alternatives that
could have been made, but that the construction
has gone too far for a revision to be made.
McCarty: Due to an action not under the control
of the homeowner and that they were victim to
another parties action.
Vote was taken by calling of the roll.
5 ayes
0 nays MOTION CARRIED.
It was noted that Mr. Engel was not in atten-
dance. Clerk /Administrator Pauley stated
that staff was recommending that a verbal
reprimand be given.
Summary of Discussion:
- Administrative costs - that this error has
cost the City additional Administrative costs.
- Contractor should have attended the meeting.
- That the contractor had not been issued a
Building Permit before starting construction
on the addition.
4. Review of Contractor's
License - David J. Engel
MOTION: Mayor McCarty made a motion, seconded
by Councilmember Hodges to direct staff to send
a letter to Mr. Engel reprimanding him for work
that was done on the addition without the issuance
