Regarding point #3 - He stated that customers do
not remain longer than 30 minutes after closing.
Regarding point #4 - He asked why arrests had not
been made if the sale of the controlled substances
had been made on the premises.
Regarding point #5 - He stated that this relates to
an altercation that ultimately resulted in the
death of a young man. He stated that this was about
a two punch fight that lasted about 30 seconds. That
it could not be helped and that it was tragic.
Further that the young man was allowed to go with a
friend and was not taken to the hospital for about
24 hours. Further that this could happen in any
establishment.
Regarding point #6 - He stated that the violations
which were listed in inspection memo of May 13,
1981, had been corrected.
Regarding point #7 - He stated that Mr. Hartinger
does accept the responsibility of the employees
which the law imposes on him.
Mr. Bergstein further stated that Mr. Hartinger pays
$7,000 per year in license fees. That he does not
know who the less desirable individuals are.
Mayor McCarty asked when he says that wrong conduct
has not been repeated, what about the complaint of
nudity of females then the complaint of nudity of
males.
Lurid conduct versus violation of the Ordinance was
discussed.
Mayor McCarty read article from the Dispatch News-
paper on December 11, 1980, regarding investigation
by undercover agents at the Launching Pad.
Mr. Bergstein stated that presently they have
dancers that are scantily dressed, but that they
are not in violation of the Codes.
Summary of further Discussion:
- Report from Ramsey County undercover agents.
- Protection of the Health, Welfare, and Safety
of the Community.
- Citations that have been issued to Mr. Hartinger.
- Wet T -Shirt contests.
- Female and Male dancers.
