Mayor McCarty questioned if the Council could require an agreement so that if the water main broke, the City would not be responsible for any damage done during its repair. Attorney Meyers replied that as part of the Development Agreement, the City would be held harmless for any damage done to a permanent structure. Mayor McCarty stated he would like an indica- tion of confidence from that applicant that if the noise did prove to be a problem, they would have a conditional use review in the future, and would the applicant be willing to put up a letter of credit or whatever regarding loss of property value. Mr. Tyson replied that he would like a chance to discuss those requirements and check into them, but that he would be willing to do anything within reason. He asked that it be remembered that there are other trucking firms in the area already that are creating noise, and that he will be doing more to surpress the noise than they have. Motion /Second: McCarty /Hodges to direct Staff to draft a tax exempt financing resolution and deve- lopment agreement with a resolution to include the Planning Commission's considerations, and give preliminary approval to the proposal, with the development agreement to include a negotiable warrantee to the adjacent property owners, to include the Mounds View Planning Commission's Resolution No. 16 -81. 5 ayes 0 nays Motion Carried Attorney Meyers asked that it be noted that the applicant was aware of the tax exempt financing requirements and that they had been given a copy of them.
