from R -1 to R -2 and to draft a development
agreement with a resolution of approval for the
subdivision and development.
Mayor McCarty closed the public hearing and
reopened the regular meeting at 9:40 PM.
Motion /Second: Hodges /Blanchard to direct
Staff to draft an ordinance for approval of
rezoning from R -1 to R -2 and to draft a
development agreement with Resolution No.
14 -81, of approval for the subdivision and
development.

Mayor McCarty explained that each Council
member had thoroughly examined all material
relative to the issue.
Motion /Second: McCarty /Doty that the
restaurant and liquor licenses for the
Launching Pad, in the name of Albert J.
Hartinger (Launching Pad) not be renewed for
July 1, 1981 for the following reasons.
Police and inspection reports that have been
reviewed by the Council indicate: 1. Complaints
of liquor being served to minors. 2. Repeated
acts that violate the provisions and spirit of
Chapter 100 of the Municipal Code, and parti-
cular 100.08 Section 16. 3. Repeated viola-
tions of the City's electrical, building, and
fire codes, notably the continuing violations
as cited in the Staff memo of 6/8/81. 4. Viola-
tions of the State health code. 5. Lack of
cooperation with the City, for example, when two
minor patrons were burned in an accident on the
Launching Pad premises, medical attention was
delayed by the proprietors or their employees
reluctance to call the Police Department.
6. Other activities that have occurred on the
premises and on file with the City indicate a
danger to the public health, safety, and welfare
of the citizens of the City and the patrons of
the Launching Pad. The Council members reported
they had reviewed all of the filed reports related
to the operations of the Launching Pad.

Clerk /Administrator Pauley stated that a
petition for referendum relative to Ordi-
nance No. 303 was filed on June 3, 1981,
consisting of 253 pages and 1215 signatures
and is in compliance with the requirements of
Chapter 5 of the Home Rule Charter.
Mayor McCarty recommended that the Park bond
be put on the same ballot.
