t was the concensus of the Council that the lot
in question definitely needed drain tile, and in
order to protect the City from a lawsuit by a future .
purchaser of the home, that drain tile should be
required.
Motion /Second: McCarty /Doty to deny the request of
Timberline Homes, Inc. to omit the drain tile at
7741 Greenwood Drive.

Clerk /Administrator Pauley stated the Planning
Commission is in the process of reviewing
Chapter 40 and recommended any implementation
of code procedures should wait until they are
finished. Official Rose stated they would most
likely be completing it in January.
Mayor McCarty pointed out that the developer
is required to include a negotiable warrantee
to the adjacent property owners, and recommended
it be stipulated in Exhibit 2A of the development
agreement.
.ir. Tyson stated that any violation of MPCA
standards would come under State jurisdiction,
and they could be shut down if they violated
the standards.
Mayor McCarty asked for some type of written
agreement that could be given to the mobile home
park owner. Mr. Tyson replied he would be glad
to put in writing that he would not violate the
State standards. He added that he would prefer
not having to build a wall, as they would
rather use bearming, screening and trees and so
forth.
Official Rose explained Item 5 of Exhibit 2A had
been included as it was referred to on the site
plan. It was agreed to change the wording to
read that the developer agrees to install an
adequate buffer, reference Chapter 40.04 sub G.
Motion /Second: McCarty /Doty to approve Resolution
No. 1383 and waive the reading of the resolution.

Police Department donate the bicycles to the
Goodwill.
