HomeMy WebLinkAboutResolution 7903 RESOLUTION NO. 7903 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION UPHOLDING THE PLANNING COMMISSION'S DENIAL OF A VARIANCE FOR AN ACCESSORY BUILDING TO EXCEED THE 18 FOOT HEIGHT LIMIT AT 8027 WOODLAWN DRIVE; PLANNING CASE VR2011-008 WHEREAS, the applicant, Tim Downing, property owner of 8027 Woodlawn Drive, has applied for a variance to allow a 22 foot 10 inch tall garage on his property; and, WHEREAS, 8027 Woodlawn Drive is zoned R-1, Single Family Residential, and legally described as: Woodlawn Terrace, Lot 24, Ramsey County, Minnesota PIN 05-30-23-32-0033 WHEREAS, the purpose of the variance provision in the Zoning Code is to give relief to property owners when the strict enforcement of the zoning code requirements restricts the improvement of property due to practical difficulties brought about by unique or extraordinary features of the physical property that are beyond the property owner's control; and, WHEREAS, on December 7, 2011, the Planning Commission held a duly-noticed public hearing and received resident applicant and staff input regarding this request; and, WHEREAS, on December 7, 2011, the Planning Commission approved Resolution 955-11, a resolution denying the variance request by Tim Downing due to a lack of demonstrated practical difficulty; and, WHEREAS, on February 3, 2012, the applicant submitted a written appeal, requesting that the City Council overturn the Planning Commission's denial; and, WHEREAS, on March 12, 2012, the City Council held a duly-noticed public hearing about this appeal; and, WHEREAS, the Mounds View City Council has reviewed the following documents regarding this proposal: 1. Zoning Map 2. Aerial View 3. Photographic Documentation 4. Drawing of As-Built Garage 5. Letters from Applicant, dated Oct. 10, 2011 and Dec. 2, 2011 6. Staff Report, dated March 12, 2012 7. Planning Commission Resolution 955-11 Resolution 7903 Page 2 WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View Municipal Code, the Planning Commission is to review a standard set of criteria, of which all must be satisfied, in order to grant a variance to the Zoning Code. WHEREAS, the purpose of the variance provision in the Zoning Code is to give relief to property owners when the strict enforcement of the code requirements imposes hardship thereby restricting the improvement of the property due to practical difficulties brought about by the unique or extraordinary features of the physical property that are beyond the property owner's control; and, NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council does hearby uphold the decision of the Mounds View Planning Commission to deny Tim Downing, property owner of 8027 Woodlawn Drive, a variance to allow a detached garage to exceed the 18-foot accessory building height limit, incorporating herein by reference, the same findings of fact as stated in the Planning Commission's resolution of denial.
