RESOLUTION NO. 4625
A RESOLUTION ESTABLISHING A SEPARATE ACCOUNT FOR CABLE
FRANCmSE FEES AND SPECIFYING THAT THE FUNDS IN TInS ACCOUNT MAY
ONLY BE USED FOR CABLE-RELATED ACTIVITIES
WHEREAS, the City of Mounds View is a member of the North Suburban Cable
Communications Commission, which was established by a Joint and Cooperative Agreement
between the Cities of Arden Hills, Falcon Heights, Lauderdale, Little Canada, Mounds View,
New Brighton, North Oaks, Roseville, S1. Anthony and Shoreview, pursuant to Minnesota
Statutes Section 471.59; and
WHEREAS, the Grantee of the cable franchise pays franchise fees to the City; and
WHEREAS, the cable subscriber ultimately bears the cost of the franchise fees and ought
to be the beneficiary of their use, either in cable franchise administration or in community cable
television programming; and
WHEREAS, Article X, Section 3, of the Joint an,d Cooperative Agreement states that,
after making its annual contribution to the budget of the North Suburban Cable Communications
Commission, the remainder of any franchise fee paid to the Member by the Grantee shall be used
for cable-related expenses; and
WHEREAS, the North Suburban Cable Communications Commission does, from time to
time, make available grants to assist the Member Cities with the purchase of video equipment to
be used for programming the municipal access channel and.to assist cities with the costs of
producing a specific program or series of programs; and
WHEREAS, in order to be eligible for such grants, a Member City must be able to
document that its franchise fees have been used primarily for cable-related activities; and
WHEREAS, the most effective way to establish such documentation is to establish a
separate account for franchise fees and specifying that the funds in this account may only be used
for cable-related activities;
NOW, THEREFORE, BE IT RESOLVED by the City of Mounds View
1.
That the City will establish a separate account for franchise fees, or their
equivalent.

That expenditures from this separate account will be restricted to cable.related
activities.
3. That cable-related activities are defined as:
a. the purchase of equipment to be used for programming. the municipal access
channel.
b. the production of a specific program or series of programs which may be shown
on the municipal access channel.
