CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING A PLANNED UNIT DEVELOPMENT
AND TWO CONDITIONAL USE PERMITS FOR EVEREST
DEVELOPMENT'S TACO BELL AND KENTUCKY FRIED CHICKEN
RESTAURANTS, PLANNING CASE NOS. 264-89 AND 265-89
WHEREAS, Everest Development has requested approval of a
Planned Unit Development and two conditional use permits to allow
Taco Bell and Kentucky Fried Chicken Restaurants at the property
located at the southeast corner of Highway 10 and Quincy Street,
legally known as Lot 1, Block 5, Mounds View Business Park~ and
WHEREAS, the Planning Commission has reviewed the
applicant's request for a planned unit development and
conditional use permits and determines that it is in conformance
with Chapters 40 and 42 of the City Code~ and
WHEREAS, the Planning Commission has determined a finding
of fact that the proposed planned unit development/conditional
use permit meets the following criteria:
a. The use will not create an excessive burden on
existing parks, schools, streets and other public
facilities and utilities which serve or are proposed
to serve the area.
b. The use will be sufficiently compatible or separated
by distance or screening from adjacent residentially
zoned or used land so that existing homes will not be
depreciated in value and there will be no deterrance
to development of vacant land.
c. The structure and site shall have an appearance that
will not have an adverse effect upon adjacent
residential properties.
d. The use, in the opinion of the City Council, is
reasonably related to the overall needs of the City
and to the existing land use.
e. The use is consistant with the purposes of the Zoning
Code and the purposes of the zoning district in which
the applicant intends to locate the proposed use.
f. The use is not in conflict with the Comprehensive Plan
of the City.
g. The use will not cause traffic hazards or congestion.

h. Adequate utilities, access roads, drainage and
necessary facilities have been or will be provided.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Mounds View approves the planned unit development
and two conditional use permit requests by Everest Development
for Taco Bell and Kentucky Fried Chicken Restaurants contingent
upon the following:
1. The planned unit development site plan, landscape
plan, grading, drainage and utility plan, lighting
plan, and the conditional use permit resolution shall
be recorded with Ramsey County.
2. The drive-through speakers shall not cause excessive
noise or be a nuisance to the surrounding property.
3. The developer must enter into and sign a development
agreement with the City.
4. The commercial condominium documents must be presented
to the City and subject to the City Attorney's
approval and subsequently recorded with Ramsey County.
5. City Staff reviews and approval of the site plan
changes presented to the City Council on 5/22/89.

SUBJECT: TACO BELL/KENTUCKY FRIED CHICKEN REVISED SITE PLAN
Subsequent to the Planning Commission's recommendation, the
Developer slightly revised the site plan. The City Council
approved the project on May 23, 1989, with the revisions to the
site plan contingent upon Staff review and approval of the
proposed revisions.
The revisions are as follows:
1. The first landscaped triangle to the right upon entering
the site has been slightly reduced in size.
2. At the m1ddle top of the site the arch has been slightly
relocated to the north (left).

3. The parking area closest to Highway 10 has beenreal1gned
to become more parallel with Highway 10.
4. The triangle island on the south side of the parking lot
has been slightly increased in size.
All of the noted revisions were done in order to allow for better
circulation on the s1te.
The drive aisles have not been reduced and they still meet or
exceed the m1n1mum requirements.
The changes allow for the same number of parking spaces as
previously proposed.
Due to the proposed changes, the green area has been reduced by
less than one percent (1%).
STAFF RECOMMENDATION: Staff has reviewed the revised site plan
and recommends approval of the minor changes.
