CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING A WETLAND ALTERATION PERMIT AND
SITE PLAN TO CONSTRUCT A FOURPLEX IN THE BUFFER ZONE OF A
WETLAND, 7656/7660 WOODLAWN DRIVE, PLANNING CASE NO. 138-83
WHEREAS, Dynamic Designers has submitted a request for a
wetland alteration permit to construct a fourplex in the buffer
zone (plans dated April 28, 1989, revised May 10, 1989 and
received May 17, 1989)~ and
WHEREAS, the proposed site plan meets all zoning ordinance
minimum lot area and yard setback requirements~ and
WHEREAS, Barr Engineering has reviewed and commented on
the wetland impact and found that the proposal does not have a
significant adverse impact on the wetland~ and
WHEREAS, the City Council requires a permit from Rice
Creek Watershed District for wetland alteration.
WHEREAS, Barr Engineering has evaluated the level of
compliance of the Dynamic Designers Woodlawn Basin Development
site plan with the provisions of Chapter 48, 49 and 49A of the
Mounds View Municipal Code (Ordinance) and the valuation process
included the review of:
1. Chapters 48, 49 and 49A of Mounds View Ordinance No.
318~
2. The "City of Mounds View Wetland Inventory" (Ramsey
Soil and Water Conservation District, December 1988)~
3. The "Flood Insurance Study" prepared for the City of
Mounds View (September 2, 1982)~
4. The Dynamic Designers Woodlawn Basin site plan dated
April 28, 1989~ and
WHEREAS, the evaluation was conducted during May, 1989~
and
WHEREAS, the Dynamic Designers submittal indicates that
the proposed development project consists of the construction of
a fourplex and a five stall garage~ and
WHEREAS, the proposed development is located on the east
side of the 1-9 wetland and the entire development is located
within the wetland buffer zoned~ and
WHEREAS, construction activities associated with the
development reportedly will not impact the 1-9 wetland~ and

WHEREAS, the entire property lies within the wetland
zoning district and as a result, a develop and no development
alternative exist for the property: and
WHEREAS, the development alternative requires a wetland
alteration permit from the 100 foot setback regulation, and the
no development alternative will result if the wetland alteration
permit from the 100 foot setback cannot be granted: and
WHEREAS, the development submittal was reviewed with
respect to each of the standards which must be met if a wetland
alteration permit is to be issued by the Council, and due to the
nature of the proposal permit standards relating to filling and
dredging in wetlands are not applicable: and
WHEREAS, the results from this review indicated that the
development proposal is in compliance with all permit
requirements: and
WHEREAS, the proposed development also includes a feature
which may be considered beneficial with respect to public
interest, and this feature is the construction of a baffled weir
at the outlet of the 1-9 wetland: and
WHEREAS, the baffled weir should prevent floating debris
which has washed or blown into the wetland from impacting
downstream wetlands.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
of the City of Mounds View approves of the wetland alteration
permit contingent upon:
1. The trash location is specifically indicated on the
site plan. It is understood that the trash will be
located between the principal building and the garage.
2. There shall be no outdoor storage.
3. Recommendations of the City Forester dated June 23,
1989, and attached hereto.
4. Construction of a baffled weir control structure at
the wetland outlet consistent with Rice Creek
Watershed District requirements.
5. Rice Creek Watershed District permit.
6. The limits of construction shall be specified, and
staked in the wetland zoning district.
7. The silt fence shall be placed in a manner which
prevents eroded materials from entering the wetland
(903 MSL contour).
