RESOLUTION NO. 4115
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION DENYING REZONING REQUEST FOR 2740 HIGHWAY 10, CONOCO,
INC., PLANNING CASE NO. 326-91
WHEREAS, Conoco, Inc. has made application to rezone
the property located at 2740 Highway 10 from B-2, Limited
Business, to B-3, Highway Business; and
WHEREAS, Chapter 40.25, Subdivision A(5), provides that
the Planning commission and city Council shall consider possible
adverse effects of the proposed amendment. It further states
that judgement shall be based upon, but not limited to, the
following factors:
1. Relationship to Municipal comprehensive Plan
2. The geographical area involved
3. Whether such use will tend to or actually
depreciate the area in which it is proposed
4. The character of the surrounding area
5. The demonstrated need for such use; and
WHEREAS, the rezoning request is inconsistent with the
City's Comprehensive Land Use Plan designation for this property
which is Mixed Use Planned Unit Development; and
WHEREAS, the request is inconsistent with the proposed
Comprehensive Land Use Plan designation for this property, which
is Limited Business; and
WHEREAS, the Mounds View Planning Commission has
reviewed the request and has recommended denial.
NOW, THEREFORE, BE IT RESOLVED that the City council of
the City of Mounds View denies the rezoning request from B-2 to
B-3 because of the following:
1. The proposed zoning does \ not conform with the
Comprehensive Land Use Plan.
