RESOLUTION NO. 5091 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION CONSIDERING OLD HIGHWAY 8 RECONSTRUCTION WHEREAS, the reconstruction of Ramsey County Old Highway 8 from the New Brighton / Mounds View city limits is identified in the County's capital improvement program; and WHEREAS, the city's engineer has concurred with Ramsey County's feasibility report; and WHEREAS, the City of Mounds View has entered into a cooperative agreement with Ramsey County to reconstruct Old Highway 8 within the City of Mounds View; and WHEREAS, Resolution Numbers 5033 Approving Construction Plans, 5034 Approving Cooperative Agreement, and 5035 Approving Parking Restrictions were approved by the City Council on November 12, 1996; and WHEREAS, Ramsey County is the contracting agent and has developed plans, specifications and advertised the project; and WHEREAS, the City of Mounds View is proposing to pay for the public improvements in part with special assessments against the benefitted properties; and WHEREAS, a copy of the resolution setting the public hearing and public hearing notices were mailed to affected properties and were published in the official city newspaper according to section 8.04 of the City Charter and Chapter 202 of the Municipal Code; and WHEREAS, a pUblic hearing was held on February 24, 1997 to consider public input regarding the proposed project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Mounds View Minnesota, concurs with Ramsey County's feasibility study and finds that the reconstruction of Old Highway 8 is feasible, necessary and cost-effective. BE IT FURTHER RESOLVED, that Ramsey County is the contracting agent for the project and has developed plans, specifications and was advertised for the project. . . . .....' . BE IT FINALLY RESOLVED, that if after sixty (GO) days has elapsed following the date of this public hearing no petition has been filed against the proposed public improvement to be assessed in accordance with Sec.8.04 of the City Charter, the City Council will act to concur in the awarding of a contract for the project as recommended by Ramsey County.
