<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 5132 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION RECOGNIZING APPROVAL OF A CONDITIONAL <br />USE PERMIT TO ALLOW AN OVERSIZED GARAGE FOR ANTHONY HONKOMP, <br />2908 ARDAN AVENUE; PLANNING CASE NO. 479-97 <br /> <br />WHEREAS, Anthony Honkomp applied for a conditional use permit to allow an <br />oversized garage at 2908 Ardan Avenue, property zoned R-l, Single Family Residential, legally <br />described as: <br /> <br />Except the West 105 Feet of the Following; the West 248.2 Feet of the South <br />131 Feet of the North 234 Feet of Lot 34, Auditor's Subdivision No. 89 <br /> <br />WHEREAS, the Mounds View Zoning Code allows oversized garages larger than 864 <br />square feet but not exceeding 1,264 square feet with a conditional use permit; and <br /> <br />\VHEREAS, the applicant proposed a 994 square foot attached garage; and <br /> <br />WHEREAS, the proposed building met all applicable setback requirements; and <br /> <br />WHEREAS, the Planning Commission has twice before approved CUPs for this garage in <br />Resolution No. 415-95 (approved 4/5/95) and Resolution No. 436-95 (approved 11/29/95); and <br /> <br />WHEREAS, the City Council has approved a CUP for this garage in Resolution No. <br />4878 (approved 1/22/96); and <br /> <br />WHEREAS, the applicant applied for reapproval of this CUP on March 17, 1997, <br />because construction of his oversized garage had been delayed beyond the one year time limit for <br />use of conditional use permits; and <br /> <br />WHEREAS, this case was not scheduled to be heard by the City Council until June 23, <br />1997 which was after the expiration of the 60-day limit for a decision, and therefore the case is <br />deemed approved, as is stated in Minnesota State Statutes. <br /> <br />NOW THEREFORE, BE IT RESOLVED that the Mounds View City Council does <br />hereby recognize approval of Planning Case No. 479-97, granting a conditional use permit for an <br />oversized garage at 2908 Ardan Avenue as shown in Exhibits 1 and 2 to this resolution, which <br />were filed by the applicant as part of his application, and as follows: <br />
