STATE OF MINNESOTA
RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR AN OVERSIZED
GARAGE AT 7150 KNOLLWOOD DRIVE; PLANNING CASE NO. 480-97
WHEREAS, Kenneth Newcombe has applied for a conditional use permit to construct a
1,264 square-foot garage on his property located at 7150 Knollwood Drive, zoned R-l, Single
Family Residential, legally described as followed:
LOT 22, KNOLL WOOD PARK, RAMSEY COUNTY
WHEREAS, The Mounds View Zoning Code allows, with a conditional use permit, up to
1,264 square feet of garage/accessory building on one lot; and
WHEREAS, the City Council has reviewed the following documents regarding this
proposal:

WHEREAS, the City Council makes the following findings that the dimensional
requirements in the Zoning Code have been met:

Area of all Accessory Buildings:
WHEREAS, the City Council makes the following findings that possible adverse effects
have been considered in its recommendation, as required by Section 1125.01 Subd. I.e.:
1. Relationship with the Comprehensive Plan.
The Comprehensive Plan encourages the development and maintenance of residential areas
so as to improve the quality, appearance and attractiveness of housing units and residential
property in general. The Comprehensive Plan designates this property, 7150 Knollwood
Drive, low-density residential. This proposal does not conflict with the Comprehensive
Plan.

2. The Geographical Area Involved.
4. The Character of the Surrounding Area
The majority of the lots in this area exceed one acre like the subject property although some
of the lots fronting nearby Woodale Drive are smaller parcels. While the proposed garage is
larger than what is typical for this area, the placement of the garage behind the home hides
the bulk of it from Knollwood Drive. The garage would be screened from the neighbors to
the south by trees on the subject property. There will be no screening from property
owners to the north.
3. Whether such use will tcnd to or actually deprcciate the arca in which it is proposed.
Removing the existing accessory building and replacing it with a large, new garage would
be a benefit to the area in the sense that it is an improvement to the property.
5. The demonstrated need ('or such a use.
The applicant has indicated that they own many vehicles that currently are parked outside.
In addition to vehicles, the applicant would plan on storing a riding lawn mower and other
assorted garden and yard equipment within the garage. The size requested is the minimum
needed to satisfy the applicant's needs.
WHEREAS, the City Council makes the following findings regarding the criteria for
approval of a conditional use permit, as required by Section 1125.0 I Subd. 3. b.:
(1) The use will not create an excessive burden on existing parks, schools, streets and other public
facilities and utilities which serve or are proposed to serve the area.
(7) The use will not cause traffic hazards or congestion.
(8) Adequate utilities, access roads, drainage and necessary facilities have been or will be
provided.
The construction of an oversized garage will not create a greater impact on existing public
facilities or services, on utilities or access roads, nor will it create an increase in traffic on
adjacent streets. The increase in runoff from the larger structure is not significant and will
not affect the drainage system.
(2) The use will be sufficiently compatible or separated by distance or screening from adjacent
residentially zoned or used land so that existing homes will not be depreciated in value and
there will be no deterrence to development of vacant land.
(3) The structure and site shall have an appearance that will not have an adverse effect upon
adjacent residential properties.
The placement of the garage so that the bulk of the structure is hidden from street view will
provide adequate screening, and will preserve the residential character of the neighborhood.
The garage will be in full view of the adjoining property to the north.

(4) The use, in the ppinion of the City Council, is reasonably related to the overall needs of the
City and to the existing land usc.
(5) The use is consistent with the purposes of the Zoning Code and the purposes of the zoning
district in which the applicant intends to locatc the proposed use.
(6) Thc use is not in conflict with the Comprehensive Plan of the City.
Garages are typical uses in residential areas, and allow for storage of vehicles and other
equipment. Having this garage will allow for the property to be kept in better order.
Improving neighborhoods by enclosing stored items is beneficial to the community and
consistent with community goals.
WHEREAS, the City Council makes the following findings regarding the requirements
which oversized garages must meet as stated in Section 1106.04 Subd. 6:

The accessory building must conform with Section 1103.06 and Subdivision 1106.03(1) of
this title.
The combined square l'ootage of all accessory buildings on one lot cannot exceed 1,264 square
feet.
If the garage square footage is greater than LOOO square fcet, no other accessory storage
building is allowed.
The building shall be designed and maintained to provide a uniform appearance with the
dwelling unit.
The width of the building cannot exceed 35 feet nor allow for more than three vehicle access.
The oversized garage will be 1,264 square-foot, and there will be no other outbuildings on
the property. The width of the garage will be 32 feet with access for two vehicles. The
garage as proposed would take up less than 2 percent of the area of the lot. The garage will
replace a smaller out-bujlding on the property. The garage is proposed to be sided in a
manner consistent with the house. The garage is consistent with the requirements in
Section 1103.06 and 1106.03(1).
f. Should the use for which the pennit was granted be changed, the pennit shall be subject to
reconsideration, revoeation or other action rcgulatcd by Section 1125.01 of this Title.
This requirement has been included as a condition in this resolution.
NOW, THEREFORE, BE IT RESOLVED that the City Council approves the conditional
use permit for a 39.5 foot by 32 foot oversized garage with two access doors with the following
stipulations:

1. The conditional use permit be recorded with Ramsey County within 60 days of City
Council approval, and a receipt of such recording shall be provided to the City of
Mounds View.
2.
The garage shall be constructed in accordance with the plans submitted, and shall be
designed and maintained to provide a uniform building appearance with the dwelling
unit.

3. The garage shall not be used for living space or other uses not allowed by the
district in which it is located or by the Zoning Code. Should the use change for
which the permit was granted, the conditional use permit shall become null and void.
4. No other accessory buildings shall be allowed on this lot.
5. The propel1y owner shall remove a twenty foot (20') section of the southern
driveway measured from its intersection with Knollwood Drive, and shall re-sod or
re-seed this area, prior to issuance of the building permit for the oversized garage.
6. The property owner shall pave the northern driveway in conjunction with this
project, but in no event later than July 1, 1998.
7. Prior to the issuance of building permits, the property owner shall sign a
development contract as required by Section 1106.06 Subd. 4 of the Mounds View
Municipal Code that requires compliance with the stipulations in this conditional use
perm i 1.
