RESOLUTION REAPPROVING THE WETLAND AL TERA TION PERMIT
FOR LOT 2, BLOCK 1, DOWNING ADDITION (2760 WOODALE DRIVE),
REQUESTED BY SHERR! RUF; PLANNING CASE NO. 510-97
WHEREAS, Sherri Ruf has requested reapproval of a wetland alteration permit to make
soil corrections, fill wetland and create additional wetland in order to establish a buildable home
site on property zoned R-2, Single- and Two-Family Residential, legally described as follows:
Lot 2, Block 1, Downing Addition, Ramsey County, Minnesota
WHEREAS, Lot 2, Block I, Downing Addition (2760 Woodale Drive) meets the
dimensional requirements of a buildable lot as set forth in Section 1 104.06 of the Mounds View
Zoning Code; and,
WHEREAS, parts of2760 Woodale Drive are covered by wetland within the
subwatershed designated as SC-2 in the City's Local Water Management Plan; and,
WHEREAS, the minimum recommended building elevation within this sub-watershed is
891.9; and,
WHEREAS, the City reviews all development that occurs within wetlands and their
buffers because of the important role that wetlands play in maintaining the ecosystem and the area
hydrology, in that they are critical to the present and future health, safety and general welfare of
the land, animals and people within the City; and,
WHEREAS, on November 27, 1995, the Mounds View City Council approved Resolution
4852, a resolution approving a wetland alteration permit for Ms. Ruf; and,
WHEREAS, the scope of the proposed work involves the filling, excavation and grading
of land within the wetland in preparation of the construction of a residential dwelling unit; and,
WHEREAS, the regulations regarding wetland alteration and mitigation have changed
since the adoption of Resolution 4852, which expired November 26, 1996; and,
WHEREAS, the Rice Creek Watershed District on October 24, 1997, approved a permit
for this project which involved the filling of3,000 square feet of wetland area and subsequent
mitigation of2,000 square feet of wetland area ((3,000 square feet - 2,000 square feet
exemption) x 2 = 2,000 square feet of required mitigation); and,

WHEREAS, the City Engineer has reviewed the grading plan dated 11/8/95 and found it
to be in compliance with the City's Local Water Management Plan, provided that a undisturbed
buffer be maintained between the landscaped area and wetland by the applicant; and,
WHEREAS, the Mounds View City Council has reviewed the proposal and finds it
consistent with the standards in the City's Wetland Zoning Ordinance, Chapter 1010.08,
Subdivision 4 as follows:

This lot will be connected to the City's sanitary
sewer system and as such will not be disposing of
wastes on site.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
approves the wetland alteration permit requested by Sherri Ruf, contingent upon the following:
1. Plans and supporting documentation for controlling erosion shall be provided by
the applicant and approved by the Community Development Director prior to the
issuance of any grading or building permits.
2. The pervious surface areas of the lots shall be sodded or landscaped (up to the five-
foot natural vegetation strip along the wetland) to prevent substantial soil loss from
the site. This will need to be accomplished before certificates of occupancy are
issued.
3.
Only clean fill, substantially free of chemical pollutants and contaminants, shall be
brought onto the site.
4. The minimum building elevation for the home to be constructed on this lot shall
not be less 891.9 as specified in the City's Local Water Management Plan.
5. No waste--solid, hazardous or otherwise--shall be allowed to enter directly or
indirectly into the wetland.
6. The applicant shall dedicate to the City a drainage easement over the wetland areas
on the lot before any permits (grading, drainage or otherwise) will be issued.
7. A five-foot wide strip of naturally vegetated land shall be left unlandscaped and
included within the easement area to further protect against contaminants
(fertilizers, etc.) from entering into the wetland.
8. The applicant shall dedicate a drainage and utility easement to the City over and
across the following parts of Lot 2, Block 1, Downing Addition:
The north ten feet, the south ten feet, the west fiv~eet, the east five feet of the
north 135, the east 65 feet of the north five feet 0 the south 170.08 feet, and the
east five feet of the south 170.08 feet of Lot 2, Bock 1, Downing Addition,
Ramsey County, Minnesota.

shall the building be set back more than thirty feet from the front property line.
10. No work (landscaping, mowing, filling, excavating, removal of vegetation, or any
other alteration of any kind) shall be permitted within the easement area.
