RESOLUTION NO. 5212
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING THE SILVERVIEWESTATES
FINAL PLAT; PLANNING CASE 501-97
WHEREAS, Silverview Estates Inc. has requested approval of a major subdivision for the
property legally known as:
That part of the Southwest Quarter of the Southeast Quarter of Section 6,
Township 30, Range 23, Ramsey County, Minnesota described as beginning at
the southwest corner of said Southeast Quarter; thence easterly along the south
line of said Southeast Quarter 1,346.90 feet to the center line of State Trunk
Highway No. 10; thence northwesterly along said center line 1,434.13 feet to the
center line of Silver Lake Road; thence southwesterly and southerly 1,219.64 feet
along said last centerline to the point of beginning. Subject to State Trunk
Highway No. 10, Silver Lake Road and St. Paul Waterworks Right of Way. Except
that part of said Southeast Quarter described as commencing at the southwest
corner of said Southeast Quarter and measuring easterly along the south line of
said Section 6 a distance of 1,346.9 feet to the intersection of the center line of
Highway No. 10 (Anoka Cut-off); thence northwesterly along the centerline of
said Highway No. 10, a distance of 765.9 feet to the point of beginning; thence
southwesterly at right angles to the center line of said Highway No. 10 a distance
of 275 feet; thence northwesterly and parallel with said centerline 100 feet;
thence northeasterly at a right angle to the centerline of said Highway No. 10;
thence southeasterly along said Highway No. 10 to the point of beginning.
WHEREAS, the above-described property is zoned PUD, Planned Unit Development;
and,
WHEREAS, a final plat date-stamped 3/2/98 and titled "SilvenJiew Estates" has been
submitted by the applicant; and,
WHEREAS, the final plat reorganizes the eight existing parcels into four platted lots,
numbered 1 through 4 of Block ], Silverview Estates; and,
WHEREAS, the Director of Public Works has reviewed the proposed plat and finds it
consistent with the City's street plan in that no additional municipal right of way will be required
as a result of this plat and that the proposed easements shown on the plat will be sufficient for the
City's utility needs; and,
WHEREAS, the final plat dedicates to the public in perpetuity those easement areas so
marked on the plat for drainage and utility purposes; and,
WHEREAS, the Mounds View City Council, on December 8, 1997, approved Resolution
No. 5183 approving the preliminary plat for Silverview Estates, with stipulations; and,

WHEREAS, the City Engineer has reviewed the final plat and finds that it conforms to
the approved preliminary plat and to the applicable City Codes; and,
WHEREAS, Ramsey County has reviewed the final plat.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
approves the final plat request by Silverview Estates Inc. contingent upon the following:
I. Before the Mayor and City Clerk! Administrator sign off on the Plat, the applicant shall
accomplish the following:
a. Make payment of the park dedication fee in the amount of $68,400 as required in
Section 1204.02 of the Municipal Code related to dedication oflands and
according to the appraisal report dated October 31, 1997.
b. Execute and arrange to have recorded with Ramsey County the separate signage
and landscape easement document and provide proof of such recordation to the
City.
c.
Execute and arrange to have recorded with Ramsey County the separate cross
access and parking easement document which allows joint use of the access
points, internal drive, drive aisles and parking by the gas station/convenience
market/car wash, the two-story office building and the senior residential facility.
The cross access and parking easement document shall be approved by the City
Attorney as to form.
d. Execute the Developers Agreement as prepared and amended by the City.
e. Provide surety or letter or credit in the amount of$113,089 prior to any work
being commenced on this project. This surety or letter of credit shall be the source
from which the City is reimbursed for all legal, engineering or consultant fees as
stated in items 3.01 and 3.02 of the signed Developers Agreement on file with the
City, unless a separate fund or deposit account is established for this purpose in an
amount and form acceptable to the City.
2.
Approval of this Plat shall be obtained from Ramsey County and recorded with the
County within 120 days of final approval of the City Council otherwise the approval of the
final plat shall be void. If the final plat approved by Ramsey County deviates substantially
from the final plat date-stamped 3/2/98 and approved by the City Council herein, the final
plat shall be brought before the City Council for reapproval.

3. Within ten days of the plat's recordation at the County, the applicant shall furnish the City
with two reproducible copies (Mylar) of the final plat showing evidence of the recording.
4. Before any City permits are issued for this PUD, the following shall be accomplished:
a. Obtain a permit from MnDOT for access onto Highway 10, drainage into the
Highway 10 right of way and any grading within the right of way.
b. Obtain written approvals or permits from Ramsey County for the final grading and
drainage plans, access and construction on County right of way, and a utility
permit for construction within the County right of way.
c. Obtain a general stormwater permit from the Minnesota Pollution Control Agency.
5. Approval of this final plat shall be subject to completion of a satisfactory "title opinion" by
the City Attorney.
