RESOLUTION NO. 5243 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING AN AMENDMENT TO THE SILVERVIEW ESTATES PUD AND DEVELOPMENT REVIEW FOR REALIFE COOPERATIVE OF MOUNDS VIEW, 7735 SILVER LAKE ROAD; PLANNING CASE NO. 530-98 WHEREAS, Realife Cooperative of Mounds View has requested an amendment to the Silverview Estates PUD and development review to allow for a reduced setback for the construction of a 77-unit cooperative living housing development, replacing a previously approved development for property located at 7735 Silver Lake Road and zoned PUD, legally described as follows: Lot 4, Block 1, Silverv;ew Estates, Ramsey County, Minnesota WHEREAS, Chapter 1119 ofthc Mounds View Municipal Code requires that any amendment to a pun be accomplished according to the guidelines established in and imposed by Chapter 1125 of the Municipal Code pertaining to amcndments and conditional uses; and, WHEREAS, the applicant specifically seeks to amend Item 5 of the approved Silverview Estates PUD documcnt which addresses the dimensional requirements of the PUD, by reducing the building setback to 23 fect and the parking lot setback to 25 feet; and, WHEREAS, Chapter 1006 of thc Mounds View Municipal Code requires that a development review be conducted for all commercial and industrial development within the City; and, WHEREAS, the Mounds Vicw City Council has reviewed the following documents regarding this proposal: 1. Planning Application, dated 5/29/98 2. Zoning and Location Map 3. Applicant's Narrative, datcd 5/29/98 4. Silverview Estates PUD, approved 12/8/97 by Resolution 5184 5. Site Plans, date-stamped 6/18198 6. Draft Brochurc for Realifc Coopcrative of Mounds View 7. Memo from Fire Marshal, dated 6/8/98 8. Planning Commission Resolution Nos. 552-98 and 553-98 WHEREAS, the City Forester has reviewcd the landscape plan as submitted by the applicant and finds them to be acceptable; and, . . . Resolution No. 5243 PUD Amendment & Development Review June 22, 1998 Page 2 WHEREAS, the Fire Marshal has reviewed the plans and finds them to be acceptable with the addition of a fire hydrant between the parking lot and Silver Lake Road as shown on the site plans dated 6/18/98; and, WHEREAS, the Mounds View City Council, by revising Item 5 of the PUD Document approved 12/8/97, finds that the site plans dated 6/18/98 are consistent with and improve upon the Silverview Estates PUD. NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council approves the PUD Amendment to the Silverview Estates PUD and the development review for the Realife Cooperative of Mounds View, subject to the following stipulations: 1. The site plans will need to be redrawn to reflect the following changes: a. The grading and utility plan, which shall be labeled as such, shall be revised to show a fire hydrant as indicated on the site plan. The fire hydrant shall be shown to be linked to the existing water main on the west side of Silvcr Lake Road. b. The grading and utility plan shall be revised to show thc exact and complete location and grading of the NURP pond behind the building. c. The sidewalk within the Silver Lake Road right of way shall be shown to extend to the intersection of County Road I and Silver Lake Road with a tewnty-foot perpendicular extcnsion to the east along the St. Paul Waterworks right of way onto which the existing mass transit bench shall be mounted. 2. The applicant shall obtain from Ramsey County access and grading permits for any and all proposed work in the county right of way and provide copies of such permits to the City for verification. 3. Before any City permits can be issued for this project, the applicant shall: a. Provide to the City three complete, full-size sets of final plans for its review and administrative approval. b. Sign off on a revision to the PUD document, approved 12/8/97, and the Developers Agreement, dated 4/20/98. 4. The change in thc tax capacity of this residential development and the impact of the change to the tax increment generated shall be examined by City staff and the City's Economic Development Authority to determine if changes to the developer's agreement assistance agreement are necessary. . . .
