RESOLUTION NO. 4422 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE REQUEST FOR A CONDITIONAL USE PERMIT BY GATEWAY FOODS, 2390 HIGHWAY 10, MOUNDS VIEW PLANNING CASE NO. 362-93 WHEREAS, Gateway Foods has requested City approval to construct a free standing, pre-fabricated, fully automated, self-service car wash in the City of Mounds View; and WHEREAS, Chapter 40 of the Mounds View Municipal Code allows car wash uses in the B-3, Highway Commercial District; and WHEREAS, the development, as proposed, requires a conditional use permit; and WHEREAS, the Mounds View City Council has reviewed the following documents regarding this development proposal: a) site Plan Dated June 15, 1993, revised September 10, 1993 b) Building Elevations Dated April 30, 1993 WHEREAS, the City Council has determined that the conditional use permit request is in conformance with the requirements of the Municipal Code, specifically Chapters 40, 42, 49 and 49A and State Statutes; and WHEREAS, the Mounds View Planning Commission has reviewed the request and recommended approval in Resolution No. 367-93. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves the conditional use permit contingent upon the following: 1. Landscaping, as approved by the City Forester, shall be installed along the South property line. 2. The facility must, at all times, be in compliance with State Laws and Minnesota Pollution Control Agency Standards for air quality and noise. . . . RESOLUTION NO. 4422 PAGE TWO ATTEST: (SEAL) 3. The hours of operation shall be 24 hours. After one year of operation the City shall hold a public hearing to solicit input on the hours of operation. If there are any negative com- ments, the hours of operation may be reduced. 4. The car wash facility shall include a blower system designed to remove as much water as feasible from the vehicle before it is allowed to exit the facility. This equipment shall operate as a customer option from April 16 to October 14 and as a mandatory service from October 15 through April 15. 5. Striping and signage shall be provided on-site designating those areas to be utilized for car stacking. 6. A performance bond shall be provided by the applicant to ensure plantings are installed per City Forester recommendation. 7. Should the primary use (Gas station) of the site change, the Conditional Use Permit shall become null and void. 8. Security camera(s) shall be operational 24 hours per day to provide visual observation of the facility by the attendant.
