CITY OF MOUNDS VIEW, MINNESOTA
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING TERMINATION AGREEMENT
AND RELEASE OF CLAIMS BETWEEN THE CITY OF
MOUNDS VIEW AND DONALD BRAGER
WHEREAS, the City of Mounds View (the "City") and Donald Brager (the
"Employee") have mutually concluded that it is in their best interests that the
employment of the Employee by the City be terminated; and
WHEREAS, at the direction of the Mayor and City Administrator, the City
Attorney and the Employee, through his attorney, have negotiated a proposed
Termination Agreement and Release of Claims (the "Agreement") to be considered by
the City Council; and
WHEREAS, Minnesota Statutes, section 465.722, subd. 4 requires the City
Council to approve the Agreement at a public hearing and otherwise governs the
terms and execution of the Agreement.
NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of
Mounds View, Minnesota as follows:

1. The Employee's resignation is hereby accepted and shall be effective
November 13, 1995.
2. The Agreement is hereby incorporated by reference and approved as
to all its terms, including, but not limited to, the payment of certain sums to obtain
the Employee's release of any and all civil legal claims that Employee may have
against the City, its Councilmembers, its officers, agents and its current and former
employees that may have arisen during the time that Employee worked for the City,
and the payment of certain other sums in payment for the Employee's accumulated
vacation and sick leave according to the City's personnel policies.
3. Pursuant to Minnesota Statutes, Chapter 363 and section 465.722, subd.
4, the effective date of the City's approval of the Agreement shall be November 28,
1995 and either the City or the Employee may rescind the Agreement before that
date.

4. The City Council hereby authorizes the City Administrator to make the
payments required by the terms of the Agreement from the following accounts:
