RESOLUTION AUTHORIZING THE EXEClJTION OF A LIMITED USE
AGREEMENT TO PERMIT THE INSTALLATION, USE AND MAINTENANCE OF A
DRIVEWAY OVER AND ACROSS lJNIMPROVED CITY RIGHT OF WAY
\VHEREAS. Spcncer Mistelske. the "Applicant" has rcquested permission from thc City
of Muunds View to install. use and maintain a driveway over and across unimproved City right
of way tu service a parcel of land fronting unimproved Laport Drive, legally described as:

WHEREAS. the Mounds Vicw City Council has revie\ved the follo\ving documents
regarding this proposal:

WHEREAS, the Mounds View City Council finds that the installation of a driveway
over and across City right of way would not he detrimental to the health. safety and public
wclf~lre of the community; and.
WHEREAS. the I'Vlounds Vicw City Council agrces to allow for such driveway
installatiunupun execution of a "Ci-rant and Acceptance of Limited Use Agreement" and.
WHEREAS, thc Mounds View City Council makes no claims or guarantees regarding the
ability of the Applicant to obtain a building permit for a residential dwelling upon said parcel nor
does execution of said agreement constitute an implicit approval of any associated building
permits.

NO'-\!, THEREFORE, BE IT RESOLVED that the Mounds View City Council
authorizes the execution of a "Grant and Acceptance of Limited Use Agreement" in a form
acceptable to the Applicant and the City.
BE IT FURTHER RESOLVED that the applicant shall be required to apply for and
obtain a \\etland buJTer permit if it is dctermined that any work will be perlormed \vithin the 100-
foot \wtland buffer.
BE IT FINALLY RESOLVED that the Applicant shall be responsible for recording the
"Grant and Acceptance of Limited Use Agreement" vl'ith Ramsey County prior to the issuance of
any building permits for the above-described parcel.
Adopted this 25th day of October, 1999.
