<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 5401 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING A WETLAND BUFFER PERMIT FOR JAMIE SHARP, <br />2551 RIDGE LANE, PLANNING CASE 577-99 <br /> <br />WHEREAS, Jamie Sharp has IUIuested approval of a Wetland ButTer Permit f()I' <br />property ohvhich he is the owncr of record. property legally known as: <br /> <br />Lot 49, Blocl( I, RED OAf( ESTATES NO.2, <br />Ramsey COlln(~', Minnesota <br /> <br />WHEREAS. the abovc-described prope11y is zoned R-1, Single Family Residential; and. <br /> <br />\,VHEREAS, said property is located within one hundred feet of an idcntiJied wetland; <br /> <br />and. <br /> <br />WHEREAS, the City Council has !()und that wetlands within the City, as part of the <br />ecosystem, arc critical to the present and future health. safety and general welhtre of the land. <br />animals and people within the City, as well as within the Rice Creek Watershed District and. <br /> <br />WHEREAS, the City Council has in mind its statutory obligation to comply with <br />Chapters J 04, 105 and 112 ofMinncsota State Law. the n.:gulations of Rice Creek Watershed <br />District. Regulations of the Department of Natural Resources. including provisions for protected <br />waters, Public Law 92.500 (Federal Water Pollution Control Act). open space policies orthe <br />Metropolitan Council and its guidelines encouraging protection and enhancement of marshes. <br />wetlands in the 1l00d plain area amI the public interest in preventing irreparable destruction or <br />deterior,ltion of valuable natural resources: and, <br /> <br />WHEREAS. Section J 01 0.08 of the Municipal Code statcs that a Wetland 13ufTer Permit is <br />required when any construction activities arc planned \vithin one-hundred teet of a wctland; and. <br /> <br />WHEREAS, the Rice Creck Watershed District has reviewed thc Delineation report <br />prepared by Arlig Environmental.. Inc.. and has found the delineation to be acceptable; and. <br /> <br />WHEREAS, no development activities or disturbances of any kind will occur \vithin the <br />wetland itself: and. <br /> <br />\V H E REAS, the entirety of the proposed house and portion of the proposed attached <br />garage ,.'ncroaches into the J nO-foot butTer area adjacent to the wetland; and. <br /> <br />WHEREAS, representatives fl"om SEH--the City's engineer--have reviewed the <br />delineation report and have determined that the home and the resulting stonnwater runoff will <br /> <br />f\1.\~jHlfl\(.il~ C\>IIIIl:I:\Rc~"lllli'1l1~\':;.IIII.J'1C <br />
