CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING A WETLAND BUFFER PERMIT FOR JAMIE SHARP,
2551 RIDGE LANE, PLANNING CASE 577-99
WHEREAS, Jamie Sharp has IUIuested approval of a Wetland ButTer Permit f()I'
property ohvhich he is the owncr of record. property legally known as:
Lot 49, Blocl( I, RED OAf( ESTATES NO.2,
Ramsey COlln(~', Minnesota
WHEREAS. the abovc-described prope11y is zoned R-1, Single Family Residential; and.
\,VHEREAS, said property is located within one hundred feet of an idcntiJied wetland;
and.
WHEREAS, the City Council has !()und that wetlands within the City, as part of the
ecosystem, arc critical to the present and future health. safety and general welhtre of the land.
animals and people within the City, as well as within the Rice Creek Watershed District and.
WHEREAS, the City Council has in mind its statutory obligation to comply with
Chapters J 04, 105 and 112 ofMinncsota State Law. the n.:gulations of Rice Creek Watershed
District. Regulations of the Department of Natural Resources. including provisions for protected
waters, Public Law 92.500 (Federal Water Pollution Control Act). open space policies orthe
Metropolitan Council and its guidelines encouraging protection and enhancement of marshes.
wetlands in the 1l00d plain area amI the public interest in preventing irreparable destruction or
deterior,ltion of valuable natural resources: and,
WHEREAS. Section J 01 0.08 of the Municipal Code statcs that a Wetland 13ufTer Permit is
required when any construction activities arc planned \vithin one-hundred teet of a wctland; and.
WHEREAS, the Rice Creck Watershed District has reviewed thc Delineation report
prepared by Arlig Environmental.. Inc.. and has found the delineation to be acceptable; and.
WHEREAS, no development activities or disturbances of any kind will occur \vithin the
wetland itself: and.
\V H E REAS, the entirety of the proposed house and portion of the proposed attached
garage ,.'ncroaches into the J nO-foot butTer area adjacent to the wetland; and.
WHEREAS, representatives fl"om SEH--the City's engineer--have reviewed the
delineation report and have determined that the home and the resulting stonnwater runoff will

. not have a nl~gative impact upon the wctland.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
approves the Wetland BulTer Permit Cor Jamie Sharp. contingent upon the following:
1. Only clean fill. substantially Ji-ee of chemical pollutants and contamimmts. shall
be brought onto the site.
2. No \vaste--solid. hazardous tH" otherwise--shall be allowed to entcr dircctly or
indirectly into the wetland.
:;. The minimum t100r elevation of the homc shall not be less than 895.2.
4. Any loss of l100d storage capacity (area bclO\v the 893. J Elevation) shall be
replaccd elsewhere on thc lot at a minimum 1: 1 ratio with the affected areas
clearly shown on the Grading Plan. including the arcas oCnUlisted in cubic feet.
Said Grading Plan sh~lllnced to be approved by thc Director of Public Works.
). Grading oCthe site shall not deviate from thc approved plan without the cxpress
\vritten consent o[the Director of Public Works after review by the City Engincer.

Construction erosion control measures designed to limit soil loss from the
development sill.' shall be installed as approved by the Dircctor of Public \Vorks
and maintained during thl' duration of the construction. not to be rcmoved until
graded areas have heen sodded or revcgetated.
7. Any additional runol1 generated by the development of the site must be
accommodated on-site. The method of handling the additional rUl10fT should be
determined based on lx'st practices as determined by qualitied consultants.
S. The applicant shall entcr into a development agreement with the City which
among other things holds the City harmless and without any liability in thc event
of llooding or water damage to the improved property.
