RESOLUTION NO. 544 t " CITY OF MOUNDS VIEW COlJ~TY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A 1,248 SQUARE-FOOT OVERSIZED GARAGE AT 2832 WOODALE DRlVE~ MOUNDS VIE\V PLANNING CASE NO. CUOO-004 \VHEREAS, Thomas Stamptle has applied for a conditional use pemlit to construct a 1,248 square-foot garage in the side yard of his property located at 2832 WoodaJc Drive, property zoned R-l, Single Family Residential, and legally described as follows: Lot 92, Kllo/lwood Park Ramsey COUllty, Millllesota \VHEREAS, The Mounds View Zoning Code conditionally allows garages in excess of 952 square feet in area \-vith a maximum accessory building area not to exceed 1,400 square feet; and, WHEREAS, the Mounds View City Council has reviewed the following documents regarding this proposal: a. Development Application Zoning Map Existing Site Plan Proposed Site Plan Location Map Photographic Documentation Letter from Applicant, dated 4/6/00 Staff Report Planning Commission Resolution 617-00 b. c. d. e. f. g. h. I. \VHEREAS, the Mounds View City Council finds that the proposal satisfies the dimensional requirements and conditional use permit requirements as outlined in Chapters 1104, 1106 and 1125 of the Zoning Code; and, \VHEREAS, the Mounds View City Council finds that the request is consistent with the Mounds View Comprehensive Plan in that the Comprehensive Plan encourages the development and maintenance of residential areas so as to improve the quality, appearance and attractiveness of housing units and residential property in general; and, WHEREAS, the\1ounds View City Council finds that the proposed garage would not be out of place given the character and geography of the surrounding area involved in that the lot is rather large and expanded garages are commonplace residential structural improvements which heIp keep properties neat and orderly; anel, - . . WHEREAS, the Mounds View City Council finds that the proposed garage would not depreciate the neighborhood in that the proposed garage would replace an older, structurally unsound garage with a sagging roof; and, WHEREAS, the Mounds View City Council finds that the applicant has sufficiently demonstrated that a need exists for the proposed oversized garage; and, WHEREAS, the Mounds View City Council finds that the proposed oversized garage would be more than adequately screened by a privacy fence, mature trees and an adjacent garage. NO\-V. THEREFORE, BE IT RESOLVED that the Mounds View City Council approves the conditional use pemlit with the [0110 wing stipulations: I. The applicant shall alTange to record the City Council resolution approving the conditional use pellllit \vith Ramsey County and provide proof of such recordation to the City within sixty days of Counci] approval or this permit shall be considered null and void. ') The garage shall not be used for living space or other uses not allowed by the district in which it is located or by the Zoning Code. Should the use change for which the permit was granted, the conditional use permit shall be considered null and void. 3. The garage shall be designed and maintai ned to be aesthetically pleasing and complementary to the existing d\velling.
