TOLD Development Company, (hereinafter, the "Developer") has applied for a Planned Unit Development to construct a Walgreens Drugstore and restaurant at the northeast corner of Highway 10 and Edgewood Drive, on properties legally-described as follows: (SEE A TT ACHED EXHIBIT]) \VHEREAS, the Developer has requested approval of the second stage of the proposed PUD process, which is the technical review of all site and improvement plans associated with the proposed development: and, \VHEREAS, according to a recent delineation performed by SEH, Inc., the proposed construction activities will occur within I OO-feet of a wetland and would involve the filling of approximately 360 square-feet of wetland area; and, \VHEREAS, according to Section 10] 0.08 of the Municipal Code, any deve]opmcnt occUlTing within a wetland requires approval of a wetland alteration permit; and, WHEREAS, the Mounds View City Council has revic\ved the following documents regarding this proposal: ]. Preliminary Plat prepared by Loucks Associates, c1ate-stamped July 13,2000, 6. Site Plan, prepared by ArchNet, date-stamped August 7, 2000 7. Landscape Plan, prepared by ArchNet, date-stamped August 7, 2000 8. Grading and Drainage Plans, prepared by Sigma, date-stamped August 7, 2000 9. Photometric Ana]ysis ] O. Planning Commission Resolution ()23-00 \VHEREAS. the dimensional requirements associated with the proposed Walgreens PUD arc consistent with the standards and intent 01" Chapter 1120 of the Mounds View Zoning Code pertaining to Planned Unit Developmcnts; and. \VHFREAS, the site plans date-stamped August 7. 2000 indicate that the PliO will be constructed in t\VO phases. Generally. the first phase will ill\'olve the relocation oCthe stormwater holding pond and construction of the Walgreens and associated infrastructure while the second phase will involve the construction of the restaurant establishment and. \VHEREAS. the site plans date-stamped August 7.2000 indicate provision of 43 parking stalls far the restaurant use and 103 stalls for the Walgreens for a combined 146 parking stalls; and. \VHEREAS. the Director of Public Works and the City Enginecr have reviewed the site. grading. utility and drainage plans and finds them to be acceptable and consistent \vith City standards subject to revisions as noted herein; and. WHEREAS. the City Forestcr has revie\ved and approved the proposcd Landscape Plans; and. \VHEREAS. thc Mounds View Fire Marshal has rcviewed and approved thc sitc and utility plans and finds them to bc consistent with applicable fire codes and fire dcpartmcnt standards: amI. \-"HEREAS. Rice Creek Watcrshed District is revie\ving the proposed grading and drainage plans and will take action after submission of the linal revised plans; and, \VHEREAS. the Mounds Vicw City Council has reviewcd the City Code rcgarding wetland alterations and finds the proposed alteration to bc consistent with such rcquiremcnts; and, \VHEREAS. the Mounds View City Council has reccived a recommendation of approval from the Mounds View Planning Commission as stated in Planning Commission Resolution 1\0. 623-00. NO'V THEREFORE BE IT RESOLVED that the Mounds Vie\v City Council approves the development review for the first phase of the Walgreens Planned Unit De\'l:lopment. subject to the following conditions, terms and stipulations: I. The developer shall revise the site plan (Page AS I ). date-stamped August 7. 2000. as f()llows: a. The bituminous traihnlYs shall be marked at a 9-f'oot \\idth rather than a 5-toot width. . . . Resolution 5453 August 14. 200() Page 3 b. The trailway within the Highway 10 right of way shall be shown to continue southeast to connect to St. Stephen Street. c. Thc sidewalk along Edgcwood Drive shall be ShO\\"ll to continue south to the intersection on Highway 10 and Edgcwood Drive. d. The access drive to the development fromlJighway 1 () shall be striped to clear]y indicate a pedestrian crossing whcre the trailway crosses the access drive. e. For safety considerations. the location of the bituminous trai]way shall be revised to show a curve orjog within thirty (30) feet of both sides ofthc development's Highway ]0 access. f. T\vo decorative lights spaced 200 feet apart shall be shown along the bituminous trai]way between Edgewood Drive and the Highway 10 access drive. Three such decorative lights. spaced 200 feet apart. shall be shown along the bituminous trailway between the Highway 10 access drive and the S1. Stephen Street right of way. ! The Exterior Signage Details page (Page A5.1) shall be re\'ised to indicate brick or masonry-based monument signage not to exceed 100 square feet. :\io pylon signage shall be permitted within this PLD. 3. The Sign Area Summary on the Extcrior Elevations page (Page /\2.1) shall be revised by reducing the total indicated building signage to 200 square feet or less and by eliminating any reference to pylon signage, instead referencing monument signage as specified on revised Page A5.1. Exterior Signage Details. 4. Thc Lighting Plan shall be revised to indicate parking lot light pole heights of 24 feet or less. elimination of the pole-mountcd supplementary nood lights and the locations of the dccorativc lighting as stipulated in 1 f above. In addition. the lighting plan shall inc]ude detai led light fixturc spcci fications. ), The Developer shall obtain Rice Creek Watershed District approval of the revised Site Grading, Drainage and Erosion Control Plan and provide proof of such permit approval to the City. :\0 City permits will be issued without evidence of an approved Rice Creek \Vatcrshed District permit. (1. As indicated in the PUD Document and Contract lor Private Development, the Dcveloper shall guarantee all landscape plantings to be living for as long as the PUD is in 10rcc. The Deve]oper shall replace any plantings deemed dead or dying by thc City Forester within thirty days rcceipt ofwrinen notification. 7. NO'V THEREFORE BE IT FLRTHER RESOL VEl) that the Mounds View City Council approves the wetland alteration pcrmit (I) to fill approximately 360 square feet of delineated wetland area, (2) to disturb and restore 220 lineal feet within the delineated wetland for storm sewer installation, and (3) to permit grading and construction activities, installation or parking areas and a pm'ed traihvay within five fect of the delineated wetland; as indicated on the Site Grading, Drainage and Erosion Control Plan, date-stamped August 7, 2000; subject to the lallowing stipulations: I. The Site Grading, Drainage and Erosion Control Plan (Page Cl J)), date-stamped August 7,2000 shall be revised as follows: a, The storm sewer sho\vn to cross the wetland shall be relocated, without moving the terminus, such that the beginning point is located 120 fed further south, thus disturbing the \vetland in the most limited extent possible, b. The specifications for the relocated stormwater pond shall be revised to show a safety shelfbelO\v the pond's expected ordinary high water level (OHWL). c. The location or the silt fence near the wetland lill area shall not encroach into the wetland area any further than is absolutely necessary to perfoml the required site improvements. J Other than what is indicated on the Site Grading, Drainage and Erosion Control Plan, date-stamped August 7,2000, no development activities shall encroach within or disturb the delineated wetland. 3. Proper and clIeetive erosion control measures shall be installed and remain functional throughout the construction period and remain in place until such time that all disturbed areas have been resodded, landscaped or are supportive of natural vegetative regrowth. 4. Only clean fill, substantially fI'ee of ehcmieal pollutants and contaminants, shall be brought onto the site. 5, \:0 waste--solid, hazardous or othenvisenshall be allowed to enter directly or indirectly into the wetland. 6. Grading oCthe site shall not deviate from the approved plan without the express written consent orthe Director or Public Works atter review by the City Engineer 7.
