PDOO-OO! \VHEREAS, TOLD Development Company (hereinaner the "Developer") has applied for a Major Subdivision to subdivide and reorganize properties within its proposed planned unit development at the northeast comer of Highway I () and Edgewood Drive; and, \YHEREAS, a preliminary plat date-stamped August 10, 2000 and titled "Alm 'NIlS /'//:'/1' On III u. .'In/)/T/uv" has been submitted by thc applicant; and, \VHEREAS, the properties included with the Major Subdivision arc legally-described as follows: (SEE ATTACHED EXHIBIT I) \VHEREAS. on January 10, 200n, the City Council of the City of Mounds View approved Resolution 5409 which gave authority to the Developer to submit an application for a Planned Unit DC\Tlopment and Major Subdivision inclusive of City-owned property: and. \VHEREAS, the City Council has reviewed the following documents relative to this proposal: I. Application. datcd May R. 2000 Zoning ;Vrap 3. Location Map 4. Property Survey. prepan:d by Loucks Associates. date-stamped June 30. 2000. 5. Preliminary Plat prepared by Loucks Associates. date-stamped August 10.2000. 6. Resolution 5409. adopted January 10.2000 7. Planning Commission Resolution 623-00. approved July 19. lOOO ') 'VHEREAS. the Comprehensive Plan recommended for approval by the Mounds View Planning Commission designates the parcels associatcd \vith the PUD as CC -Pl]D, Community Commercial Planned Unit Devclopment: and, WHEREAS. the l\'lo11nds View City Council has reviewed the proposed preliminary plat which contemplates the subdivision of City Hall property by splitting off the "Remnant Parcel" created by the new alignment of Edgewood Drive and the reorganization of Midland Videen properties to create two developable parcels fronting the realigned Edge\vood Drive and one undevelopable Outlot fronting lligh\vay 10 and finds that the proposed preliminary plat is in conformance \vith all applicable sections of the Mounds View Municipal Codc: and, . . . August I...J.. :2000 Page :2 \VlIEREAS, the City Attorney has reviewed the preliminary plat and linds it to be in conformance \vith all applicable sections orthe Mounds View \t1unicipal Code~ and. "'HEREAS, the City Council held a public hearing relative to this request on August 14, 2000; and, '''I-IEREAS, the conditions and requirements regarding the proposed exchange of real property between the City and the Developer are fully addressed in the Contract for Private Deye]opment; and. \VHEREAS. the Mounds View City Council has received a recommendation of approval from the Mounds View Planning Commission as stated in Planning Commission Resolution No. 623-00. NO\V. THEREFORE BE IT RESOLVED. having held a public hearing for the proposed major subdivision, the Mounds View City Council approves the preliminary plat for the Mounds View City Hall Addition subject to the knns and conditions as stated in the Contract for Private Development and subject to stipulations as follO\vs: 1. Developer shall revise the Preliminary Plat to indicate a minimum Jive-loot wide casement Jor drainage and public utility purposes around the perimeter of proposed Lot 2 and Lot3, Block 2, excluding the common property line between said Lots. 2. Developer shall revise the Preliminary Plat to include notations pertaining to Documents recorded with Ramsey County effectuating the proposed right ohvay vacation and sign easement area vacation. 3. Developer shall revise the drainage and utility casement area shown on the Preliminary Plat to fully encompass the proposed configuration of the relocated stonnwater pond. 4. Developer shall apply for fi.nal plat approval with the City no later than three (3) months after the date of approval of the preliminary plat; otherwise, the preliminary plat will be void unless an extension is granted by the City Council. 5. Before any permits are issued for this subdivision (building, grading or otherwise). the applicant shall have paid a park dedication fee in amount specified by the City Council as required in Section 1204.02 of the Municipal Code according to the appraisal report dated June 30, 2000.
