Charles Fischer And Gary And Janet Reinecke have requestcd approval of <br />a Wctland Altcration Pcrmit to excanltc within a wctland area on their respective properties f()r <br />which they are owner of record. properties legally known as: <br /> <br />Lof /09, Sprillg Lake Park Kllolls, Ramsey COIlII(l', Jlillllesofa ami <br />Lot /10, Sprillg Lake Park Kllolls. Ramsey COllllt)', Alblllesofa <br /> <br />WHEREAS. said propcrtics are within a designatcd \vetland area as dcfined by the City's <br />Wetland Zoning District maps: and. <br /> <br />\VHEREAS. the property owncrs are requesting City approval to cxcavate within the <br />wetland area to restore an open-watcr area of the wetland; and. <br /> <br />WHEREAS. the City Council has found that wetlands w'ithin thc City. as part of the <br />ecosystem, are critical to the prcsent amI future health, safety and general welfare of the land. <br />animals and people \vithin the City. as well as within thc Rice Creek Watershed District; and. <br /> <br />'VHEREAS. the City Council has in mind its statutory obligation to comply with <br />Chapters 104, 105 and 112 of Minnesota State Law. the regulations of Rice Creek Watershed <br />District. Regulations of the Department of\latural Rcsources, including provisions lar protccted <br />watcrs. Public Law 92.500 (Federal Water Pollution Control Act), open space policies of the <br />:vtetropolitan Counci I and its guidelincs cncouraging protection and enhanccment of marshes, <br />wetlands in the flood plain area and the public intcrest in preventing ilTcparable dcstruction or <br />deterioration of valuable natural rcsourccs; and. <br /> <br />\VHEREAS. Section 1010.08 of the Municipal Code states that a Wetland Altcration Permit <br />is requircd when any activities encroach into a designated wetland; and. <br /> <br />\VIIEREAS. Rice Crcek Watershed District (RCWD) on October 2.2000. and Octobcr <br />31.2000. approvcd the issuance of\vatershed permits lar the rcquested activity; and. <br /> <br />\VI-IEREAS. all grading and excavation activitics are to bc rcstricted to thc subjcct <br />propertics and shall not disturb any area beyond the subject properties; and. <br /> <br />\VHEREAS. represcntatives from thc City's engincer have rcviewcd the request and <br />
