RESOLUTION NO. 5561 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVAL A MINOR SUBDIVISION OF 8360 PLEASANT VIEW DRIVE AND 8360 SPRING LAKE ROAD, REQUESTED BY STEPHEN REDFIELD; MOUNDS VIEW PLANNING CASE NO. M101-001 WHEREAS, Stephen Redfield, representing property owners Michael and Patricia Robinson of 8360 Pleasant View Drive and Pierre and Mary Dumas of 8360 Spring Lake Road, has requested approval of a minor subdivision of 8360 Pleasant View Drive and 8360 Spring Lake Road, properties zoned R-1, Single Family Residential, and legally-described as follows: Subject to Road, the South Half of Lot 6, Auditor's Sub. No. 89, Ramsey County, Minnesota WHEREAS, the applicant proposes to subdivide the rear 135 feet from 8360 Spring Lake Road and combine it with a section of right of way attached to 8360 Pleasant View Drive which is proposed to be vacated to create an 18,236 square foot buildable lot fronting Pleasant View Drive with a proposed legal description as follows: Except the East 215.00 Feet, that Part of the South Half of Lot 6, Auditor's Subdivision No. 89, Lying Easterly of a Line 60 Feet Easterly of and Parallel with the West Line of Pleasant View Drive, County of Ramsey, State of Minnesota WHEREAS, the City Council has reviewed the applicant's request for a minor subdivision and has determined that it is in conformance with Chapters 1104, 1201, and 1202 of the Municipal Code; and WHEREAS, the City Council finds that the applicant's request for a minor subdivision is in conformance with the Comprehensive Plan; and, . . . Resolution 5561 Page 2 WHEREAS, the applicant has submitted a Registered Land Survey (RLS) for the above described property; and, WHEREAS, the Engineering Technician and Public Works Director for the City of Mounds View have reviewed the proposed minor subdivision and has found it acceptable; and, WHEREAS, the submitted Registered Land Survey has been forwarded to the City Attorney for review; and, WHEREAS, in accordance with Section 1204.04, Subd. 4, a park dedication fee in the amount of $794 is applicable with this proposed minor subdivision; and, WHEREAS, the excess highway easement area identified in the subdivision serves no identifiable public purpose and it would be in the public interest to vacate such excess easement area. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council hereby approves the minor subdivision of 8360 Pleasant View Drive and 8360 Spring Lake Road to create a new 18,236 square foot lot, requested by Stephen Redfield, subject to the following: 1. Prior to the City Council approving this subdivision, the applicant shall submit the required park dedication fee in the amount of $794.00. 2. The Registered Land Survey shall include language which states, "A separate drainage and utility easement document has been executed and recorded with Ramsey County." 3. Approval is subject to review of City Attorney review of the Registered Land Survey. The applicant shall make any changes as deemed necessary by the City Attorney. 4. Approval of the subdivision is contingent upon the applicant receiving approval of the vacation of excess highway easement via City Council adoption of Ordinance 680. 5. The applicant shall record this Resolution 5561, the Registered Land Survey, the easement document and Ordinance 680 with Ramsey County within sixty (60) days of final adoption, and present proof of such recording to the City of Mounds View. Failure to record these documents or provide proof of such recordation shall cause this approval to be null and void. . . .
