CITY OF MOUNDS VIE\V COUNTY OF RAl\lSEY STATE OF lVlINNESOT A RESOLUTION NO. 2001-5700 RESOLUTION TERMINATING THE Ei\lPLOY'lENT OF BRUCE KESSEL FROl\l THE CITY OF MOUNDS VIEW WHEREAS, the City Clerk-Administrator for the City of Mounds View (the "City") has the authority under the City's Personnel Manual to terminate employees of the City subject to the COnClln"enCe by the City Council (the "Council"); and WHEREAS, the City Clerk-Administrator has recommended that it is in the best interest of the City that the employment of Bruce Kessel (the "Employee") be terminated, and WHEREAS, the City Clcrk-Administrator's recommendation is based on Issues concellling the unsatist~lctory performance of the Employee, the allegations set fOl1h in the May 30, 2001, suspension letter provided to the Employee, as well as a summary recommendation of the City Clerk-Administrator; and WHEREAS, the Council is aware of certain performance issues relating to the Employee based on the summary recommendation of the City Clerk-Administrator and the supporting documentation related thereto; and WHEREAS, the Council also relics on the professional expertise and opinion of the City Clerk-Administrator obtained during the administration of the City's business concellling the quality and completeness of Employee's \vork; and WHEREAS, the Employee has been advised of the allegations against the Employee; and SJR.Il)~5xx\" I \11 :210.71 . . . WHEREAS, the Employee did take the opportunity to utilize his due process right in addressing the Council in response to the May 30, 2001, suspension letter and the recommendation memorandum of the City Clerk-Administrator. NOW, THEREFORE, BE IT RESOLVED TI-IA T thc above-referenced recitals are incorporated herein to this Resolution. NOW, THEREFORE, BE IT FURTHER RESOLVED THAT the City Council of the City of Mounds View terminates the employment of the Employee effective June 7, 2001. NOW, THEREFORE, BE IT FURTHER RESOLVED THAT the City Council directs City staff to provide an appropriate Notice of Temlination to the Employee with the cfTective date oftemlination on June 7, 2001.
