COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION DENYING AN APPEAL OF THE PLANNING COMMISSION DENIAL
OF A VARIANCE FROM THE MINIMUM SETBACK REQUIREMENT FOR
ACCESSORY STRUCTURES TO ALLOW A ZERO-FOOT SETBACK FOR A
STORAGE SHED ON THE PROPERTY LOCATED AT 5532 ST. STEPHEN STREET;
MOUNDS VIEW PLANNING CASE VR01-005
WHEREAS, The applicant, Arlen Baumhoefner, applied for a Variance to allow a
zero-foot setback to construct a storage shed on the property located at 5532 St.
Stephen Street; and,
WHEREAS, 5532 St. Stephen Street, a through lot, is zoned R-1, Single Family
Residential, and is legally described as follows:
Lot 10, Block 4, Dailey's Hillview Addition
Ramsey County, Minnesota
WHEREAS, The Mounds View Planning Commission held a public hearing on
June 20, 2001 regarding the request and after taking testimony and reviewing the facts
of the request, approved Resolution 660-01, a resolution denying the requested
variance due to a lack of demonstrated hardship; and,
WHEREAS, on August 13, 2001, Mr. Baumhoefner appealed to the City Council,
requesting that the Council overturn the decision of the Planning Commission.
WHEREAS, on August 13, 2001, the City Council held a public hearing regarding
this appeal; and

NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Mounds
View does hereby uphold the decision of the Planning Commission to deny Mr.
Baumhoefner's variance from the minimum setback requirement for accessory
structures to allow a zero-foot setback for a storage shed, citing by reference the same
findings pertaining to the lack of demonstrated hardship as presented in Planning
Commission Resolution 660-01.
Adopted this 13th day of August, 2001.
