CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION ADOPTING ADMINISTRATIVE POLICY 91 -1 REGARDING
FORFEITURE/EQUITABLE SHARING PROGRAM
WHEREAS, the City Council wishes to participate in the
Federal and State Forfeiture/Equitable Sharing programs when
appropriate; and
WHEREAS, the City Council believes that the continued
practice of the Mounds View Police Department to make application
for seized and forfeited asstes is in the best interest of law
enforcement; and
WHEREAS, the City Council believes that these program
resources allow a unique opportunity to provide supplemental
funding to augment the police budget and provide for expenditure
usages not available in the annual budgetary appropriation; and
WHEREAS, the City Council feels that a policy of fund
management, expenditure guidance and program accountability are
important aspects of the program and that it is in the public
interest to establish a policy of program administration.
NOW, THEREFORE, BE IT RESOLVED that Administrative
Policy 91 - 1 regarding the Forfeiture/Equitable Sharing Program
is hereby adopted.
BE IT FURHTER RESOLVED that said administrative policy
be attached to the original copy of this resolution and become a
part of the city's Administrative policy Manual.

FORFEITURE/EOUITABLE SHARING PROGRAM
Philosophy
The purpose of this Administrative Policy is to set forth the
city's policy concerning the application and usage of funds
acquired under the Federal and State Forfeiture/Equitable Sharing
Program.
The intent of this policy is to establish guidelines for the
application, usage, investment, and auditing of funds obtained
within this program.
The City believes that the acqu~r~ng, expenditure, and management
of funds obtained through the Forfeiture/Equitable Sharing
Program provides additional opportunities to supplement the
Police Department'sbudget. This policy does not apply to funds
otherwise acquired and approved outside of this program.
ApPlicabilitv:

All funds and/or other property acquired consistent with
Federal and State Forfeiture and Equitable Sharing laws.
stipulations:
1. Application for funds and/or property available under the
Federal or State Forfeiture/Equitable Sharing program shall
be made under the direction of the Chief of Police.
2. Funds and/or property seized under this program shall be
used consistent with Federal and State guidelines and only
for law enforcement purposes.
3. Funds not being actively used shall be invested consistent
with City policy and applicable State laws and at the
direction of the Director of Finance and the Chief of
Police.
4.
The city's Purchasing Policy shall apply to expenditures of
funds acquired under the Federal or State Forfeiture/
Equitable Sharing Program with the exception that for
purposes of determining applicability of the purchasing
policy purchases of $5,000 and under are considered to be
budgeted purchases.

5. All program records, fund accounting and expenditures shall
be consistent with generally accepted accounting principles
as promulgated by the Government Finance Officers
Association of the United states and Canada and shall be
made available to the City's aUditing firm upon request.
Annual Reports:
An annual summary report of funds received and expended shall be
provided to the City Council at each year's end and as part of
the City'S annual audit report.
Proposed Expenditures:
This program provides an opportunity to use resources for funding
and/or equipment replacement plus other usages not available as
part of the Police Department's regular annual budget
appropriation. Authorized expenditures are for:
1. Supplemental capital items and specialized equipment not
available in the operating or capital improvements budgets.
Such items include but are not limited to: equipment for
crime processing or investigations, evidence gathering,
communications, firearms, firearms range, safety equipment,
and other general equipment.
2.
General community programs dealing with chemical abuse,
awareness and prevention, i.e., the DARE program and
selected programs.
3. Specialized and general training programs, specifically
those that are drug related.
4. Program accreditation by the Commission on Accreditation for
Law Enforcement Agencies, Inc.
