CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RATIFYING THE LABOR CONTRACT
WITH LAW ENFORCEMENT LABOR SERVICES, INC. (L.E.L.S),
LOCAL NO. 232 (POLICE SERGEANTS) FOR 2004-2005
WHEREAS, the City Council of the City of Mounds View does hereby ratify the LELS,
Local #232 (Police Sergeants) Contract for the year 2003, with the following amendments:
1. Article 9 Probationary Periods
9.1 All newly hired or rehired employees will serve a twelve (12) months'
probationary period.
9.2 All employees will serve a six (6) months' probationary period in any job
classification in which the employee has not served a probationary
period.

9.3 At any time during the probationary period a newly hired or rehired
employee may be terminated at the sole discretion of the EMPLOYER.
9.4 At any time during the probationary period a promoted or reassigned
employee may be demoted or reassigned to the employee's pervious
position at the sole discretion of the EMPLOYER.
2. Article 14 Overtime
14.1 Employees will be compensated at one and one-half (1 %) times the
employees' regular base rate for hours worked in excess of the
employee's regularly scheduled shift. Changes of shifts do not qualify
an employee for overtime under this Article.
14.2 Overtime will be distributed as practicable.
14.3 Overtime refused by employees will for record purposes under Article
13.2 be considered an unpaid overtime worked.
14.4 For the purposes of computing overtime compensation, overtime hours
worked shall not be pyramided, compounded or paid twice for the same
hours worked.

14.5 Overtime will be calculated to the nearest fifteen (15) minutes.
14.6 Employees have the obligation to work overtime or call backs if
requested by the EMPLOYER unless unusual circumstances prevent the
employee for so working.

14.7 Employees may take compensatory time in lieu of overtime pay.
Compensatory time may be calculated up to fifty (50) hours.
3. Article 17 Insurance
17.1 The EMPLOYER will contribute to each employee per month a
maximum amount equal to eighty percent (80%) of the lowest cost family
health insurance for employee and family health insurance and basic life
insurance.
17.2 Employees may designate any unused portion of the EMPLOYER
contribution amount to provide dental coverage and/or supplemental life
insurance offered according to established guidelines through the City's
plans.
17.3 The Employer will contribute a maximum amount of $613.30 per month
in 2004 to each full-time permanent employee, for group health, dental
and life insurance including dependant coverage.
17.4 The EMPLOYER will contribute a maximum amount of $672.30 per
month in 2005 to each full-time permanent employee, for group health,
dental and life insurance including dependant coverage. If the increase
in the lowest cost group health insurance premium for family coverage in
2005 is 15% or greater, the City will contribute an additional $10 per
month per employee.
Article 22 Severance Pay
22.1 Any employee who has accumulated 960 hours of sick leave as of
January 1, 2005, and who have completed ten (10) years of service will
be eligible to receive severance pay in the amount of fifty percent (50%)
of unused sick leave. Upon death of the employee, the beneficiary of
the employee shall be paid the benefit.
22.2 Any employee who has accumulated a minimum of 960 hours of sick
leave as of January 1, 2005 will be eligible to contribute sixty-five percent
(65%) of the employee's accumulated and baked sick leave for
contribution to the employee's designated health savings plan.
Employees who have accumulated a minimum of 960 hours of sick leave
as of January 1, 2005, will be covered by the Retirement Health Savings
language of Section 22.3.
22.3 Retirement Health Savings
The City of Mounds View offers its employees a Retirement Health
Savings Plan pursuant to Internal Revenue Code regulations through a
third party administrator selected by the City.
The following contributions will be allowed to the Retirement Health
Savings Plan:

A.
Upon separation from employment with the City, an employee
may contribute their compensation for accrued vacation and
compensatory time. Employees who have completed two years
of service and leave in good standing may also contribute fifty
percent (50%) of unused sick leave calculated against a
maximum accumulation of 960 hours. Additional bank sick leave
hours will not be computed for the contribution.
B. An employee may elect to contribute a percentage of their annual
pay to the plan on a pre-tax basis. Once this election is made, it
can never be changed.
C. An employee may elect to make an after-tax contribution of their
annual pay to the plan. This election may be changed each
year, but is limited to 25% of total contributions to the plan by all
employees.
D. An employee may annually elect to contribute a portion of their
sick leave balance to the plan. The employee would have to
maintain a minimum balance of 480 hours of sick leave after the
contribution and would be allowed to convert up to 160 hours of
sick leave into 80 hours of RHS contribution per year at a 2 to 1
rate. This election may be changed each year.
22.4 An employee will be compensated for accrued vacation and
compensatory time upon separation.
Article 27 Post Licensure
The EMPLOYER will pay $90.00 toward the cost of maintaining POST
licensure.
Appendix A: Wages Increases effective January 1,2004, January 1,2005 and
July 1, 2005 as specified in the chart.
NOW, THEREFORE BE IT RESOLVED that the Mounds View City Council
does hereby ratify the LELS, Local #232 (Police Sergeants) Contract effective January 1,
2004 and expiring on December 31, 2005.
