RESOLUTION AUTHORIZING FIRE INSPECTION SERVICES AGREEMENT
WITH SPRING LAKE PARK FIRE DEPARTMENT, INC.
WHEREAS, the City of Mounds View has historically engaged in the services of a
fire marshal for fire inspection and prevention services; and,
WHEREAS, over the preceding twenty years, said services have been provided
either by a city employee or by independent contractor; and,
WHEREAS, with the resignation of the City's fire marshal in July and no one on staff
certified to provide such services, the City requested assistance from the Spring Lake Park
Fire Department, Inc. (SBM Fire); and,
WHEREAS, Fire Chief Zikmund has prepared a Memorandum of Understanding
articulating services to be provided acceptable to the City of Mounds View.
NOW, THEREFORE BE IT RESOLVED THAT the Mounds View City Council
approves the Fire Inspection Services Memorandum of Understanding submitted by the
Spring Lake Park Fire Department, Inc. at the indicated flat rate of$50 per hour.

Memorandum of Understanding

RE: Fire Inspection Services for the City of Mounds View
Purpose: V`.
This memorandum of understanding outlines the agreement between the Spring Lake Park Fire
Department Inc. (Fire Department) and the City of Mounds View specific to the City of Mounds
View contracting with the Fire Department to provide Fire Inspection Services.
Method and Liability:
The Fire Department will provide said services using certified fire inspectors/marshals who will
be employees of the corporation thus ensuring all insurances and tort immunity provisions are
in force.
Rate:
The Fire Department will provide fire inspection services for a flat rate of$50 an hour. All
components of fire code inspection and enforcement; training, certification, code books,
vehicle, uniform, correspondence, etc. are inclusive in the rate except scheduling. The rate
shall be based on quarter hour increments and any travel time shall be included with starting
location of Fire Station One located at 1710 County Highway 10.
Scheduling:
The City of Mounds View, in communication with the Fire Department, will schedule
inspections based on inspector availability as determined and agreed upon in advance. The
inspector will schedule all re- inspections.
Scope:
All commercial, industrial, assembly, storage properties and Multi-Family properties with more
than 4 units would be inspected on a regular basis using the current/historical rotation
schedule which is based on the principle of the higher the hazard, the more frequent the
inspection. For example, assemblies and manufacturing with hazardous chemicals or
operations would be inspected yearly. Low hazards would be inspected every 3 to 5 years.
The scope does NOT include any residential or multi-family units with four or less units.
The scope does NOT include plan review for new construction, new alarms, or new suppression
systems. However,this can be provided at the same hourly rate.
The scope does NOT include appeals process time and preparation which would be billed in
addition. We have had one appeal in Mounds View the past 19 years which took an estimated
6 hours of additional time; preparation for the hearing and the hearing. The appeal did NOT go
to the state level or to court.
All inspections will ire be limited and focused solely to the most current adopted edition of the
Minnesota State F Code.
Time:
Commercial, Industrial, Assembly, Business, Storage, Etc. 240 to 275 hours per year
Multi-Family Properties with more than 4 units 45 to 55 hours per year
Plan Review As needed
Operational Permits (fireworks tents, etc.) As needed
Terms on Agreement:
This agreement shall remain in effect until the City of Mounds View terminates the agreement
providing the Fire Department a minimum of a two week written notice.
Reporting:
The Fire Department shall provide a monthly activity report summarizing all inspections,
provide copies of all written orders, shall notify the City of Mounds View when serious code
violations are present that may warrant issuance of citations and when requested, appear
before council to give a verbal report.
Effective Date:
This Memorandum of Understanding shall be in effect beginning September 1, 2013.
