CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
AWARDING A CONSTRUCTION CONTRACT, AWARDING A MOVING AND
STORAGE CONTRACT, AND APPROVING A LETTER AGREEMENT WITH
SEH FOR THE CITY HALL REHABILITATION PROJECT
WHEREAS, on July 25, 2005, the City Council approved Resolution No.
6583, which approved the final plans and specifications and set a bid date of
August 24, 2005 for the City Hall Rehabilitation Project; and
WHEREAS, bids for the City Hall Rehabilitation Project were received at
1 :00 p.m. on Wednesday, August 24, 2005 at City Hall and were composed of
the base bid to perform the rehabilitation construction of the building and a bid
alternate for a "tower" style entrance; and

WHEREAS, a total of ten (10) bids were received for this project, with the
base low bid of $1,185,000.00 being submitted by Arkay Construction
Incorporated of Golden Valley, Minnesota with a bid alternate for the "tower" style
entrance of $30,000.00; and
WHEREAS, the bid from Arkay Construction Incorporated has been
reviewed and found to be in order and Arkay Construction Incorporated has met
the prequalification requirements; and
WHEREAS, on September 7,2005, the engineering firm of Short, Elliott,
Hendrickson, Inc. (SEH) submitted a letter of agreement to provide construction
administration services for the City Hall Rehabilitation Project; and
WHEREAS, should this project proceed, it is recommended that the City
utilize the construction administration services of SEH to over see the project and
ensure that the contractor adheres to the plans and specifications; and
WHEREAS, the estimated cost of construction administration service work
is 46,000; and
WHEREAS, quotes for moving all City Hall items for the City Hall
Rehabilitation Project were solicited and a total of three (3) quotes were received
with the low quote submitted by True-King Inc. in the amount of $6,012.00 with
additional items that will be needed for the move that can be provided by Truc-
King as included in their price list; and

WHEREAS, in addition to construction administration services, moving
and storage costs, there are several other anticipated costs that could be and
may be encountered as part of this project; and

WHEREAS, each item will require City Council approval and will be
presented to the City Council at a later date; and
WHEREAS, The total estimated City Hall Rehabilitation Project costs,
including all of the aforementioned items, is $1,409,300; and
WHEREAS, the Special Projects Fund of the 2005 budget (Account No.
280-4160-7050) has $1,600,000 budgeted for the City Hall Rehabilitation Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Mounds View, Ramsey County, Minnesota as follows:
1. That the Base Bid from Arkay Construction Incorporated of Golden
Valley Minnesota in the amount of $1,185,000.00 for the City Hall
Rehabilitation Project is the lowest responsive bid.
2.
That a contract to perform said work is awarded to Arkay
Construction Incorporated and that the Mayor and City
Administrator are hereby authorized and directed to enter into a
contract with said bidder, contingent on City legal Counsel
approval.

3.
That a bid alternate for the "tower" style entrance was submitted in
the amount of $30,000.00 is hereby REJECTED. Funds that would
have been spent on this bid alternate will be applied towards the
replacement of the City Hall Message Board.
4. The Public Works Department is authorized and directed to return
the deposit made for said bids, except the deposit of the successful
bidder, which shall be retained until a contract has been signed.
5. The execution of a letter of agreement for construction
administration services with SEH in an amount not to exceed
$46,000.00 is hereby approved.
6. The Mayor and City Administrator are hereby authorized to execute
said Letter of Agreement, contingent on City legal Counsel
approval.
7. A contract to perform moving activities as well as provide storage
facilities and moving material for the City Hall Rehabilitation Project
is awarded to True-King Incorporated.

The Mayor and City Administrator are hereby authorized and
directed to enter into a contract with said contractor, contingent on
City legal Counsel approval.

The funds to administer the aforementioned contracts associated
with the City Hall Rehabilitation Project are to be derived from the
Special Project Account (Account No. 280-4180-7050) and other
applicable funding sources such as the Cable Television Fund.
10. The City Administrator is authorized to make minor adjustments to
these contracts provided that they do not exceed $5,000, and that
any such adjustments be reported to the City Council at the next
scheduled meeting.

We have arriv'ed at the end of the Bidding Phase of your project and now it is time to share this information
with decision makers to determine if they want to award a construction contract for the above referenced
project. In a subseClnant letter we have made a recommendation to award the project to Arkay Construction.

FEES FOR SERVICES
The architect shall be paid on the following basis:

SCHEDULE
The following is our understanding of the project schedule:
The Architect's services shall be performed according to the details of the Construction Documents, should the
contractor fail to perform their responsibilities described in the Construction Documents we will self perform
these services and recommend the Owner deduct them from the Owner/Contractor Agreement. The Contractor
has stipulat.:d in the Bidding Documents that the work will be completed before April 2, 2006. If the work
extends beyond that your fees for added services will be adjusted accordingly and again the Owner reserves the
right to charge the Contractor for the extension in time. This is described in Section 01315 of the Construction
D0CllIllCntS.
REMARKS
This ktter represents the entire understanding between you and SEH in respect to the project and may only be
mlldified in writing, signed by both parties. We look forward to working with you on this project. If this letter
proposal satisfactorily sets forth the conditions of our agreement, please sign in the space below and return one
copy to our office and we will execute an amendment to AlA B 151 Agreement. This letter agreement will be
incorporated as an exhibit into the agreement to describe help describe the work to be provided. Thank VOll
