RESOLUTION NO. 6088
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
AWARDING THE CONSTRUCTION CONTRACT FOR THE COUNTY ROAD
SIDEWALK PROJECT AND AUTHORIZING THE MAYOR AND CITY
ADMINISTRATOR TO EXECUTE SAID CONTRACT
WHEREAS, pursuant to Resolution No. 6078 adopted by the City
Council on August 25, 2003 sealed bids were received and tabulated on
September 4, 2003, at 10:00 a.m. for the County Road H Sidewalk Project; and
WHEREAS, the low responsive and responsible bid was received
from Ti-Zack Concrete Incorporated with a base bid of $149,877.50, an alternate
bid of $234,037.10 equaling a sum total of $383,914.60; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Mounds View, Ramsey County, Minnesota as follows:
1.
That the (Base or Total) bid of Ti-Zack Concrete Incorporated in the
amount of ($149,877.50 or $383,914.60) for the County Road H
Sidewalk Project is the lowest responsive bid.
2.
That a contract to perform said work is awarded to Ti-Zack
Concrete Incorporated and that the Mayor and City Administrator
are hereby authorized and directed to enter into a contract with said
bidder.
3. The Public Works Department is authorized and directed to return
the deposit made for said bids, except the deposit of the successful
bidder, which shall be retained until a contract has been signed.

Dear Mayor and Council Members:
On September 4, 2003, at 10:00 a.m., 4 bids were received for the above-referenced
project. The project consists of the construction of a 6 ~-foot concrete sidewalk along the
north side of County Road H, from Edgewood Drive on the east to the west city limits.
Included in the project were retaining walls, hydrant relocations and restoration. The bids
were set up with a Base Bid, which included all work to construct the improvements from
Edgewood Drive to Knollwood Drive, and an Alternate Bid which included the segment
from Knollwood Drive to the west city limits. The low bid was submitted by Ti-Zack
Concrete, Inc. from Le Center, Minnesota. A summary of the bid results is shown below.

The base bid represents approximately 4,800 linear feet of sidewalk. The alternate bid is
for approximately 1,500 linear feet. The reason for the high cost for the alternate bid, is
the work required near Spring Creek. Organic soils were found in this area from soil
borings that we took. These soils and the need to maintain the construction within the
existing right of way required the need for sheetpiling, guardrail, railings and special
storm sewer needs to extend the existing culvert. Based on the low bid, these "extra"
items increased the sidewalk project in the alternate bid, by approximately $126,400.
Three addendums were prepared for this project and sent to all plan holders. The second
addendum included a new Bid Fonn that was listed as being on "Yellow" paper, when in
fact the Bid FornI was on "Pink", The third addendum infornIed the contractors to submit
their bid on the correct color of the Bid Form sent out with Addendum 2, and extended
the completion date for the project. The Bid Form has a place for acknowledgement of
addendum(s). The low bidder acknowledged the first 2 addendums, but not the third.
Since the bid was submitted on the correct form, this failure to acknowledge the Third
Addendum could be considered an irregularity in the bid. The City Attorney should be
contacted for his opinion. A tabulation of the bid is attached for your review.

We have not had experience with Ti-Zack Concrete, so we contacted the references
supplied. Based on my discussions with the references and information provided by the
contractor, we have determined that they have (1) have a sufficient understanding of the
project and equipment to perform the construction for which it bid; and (2) according to
their bonding agent they presently have the financial ability to complete the project bid.
SEH makes no representation or warranty as to the actual financial viability of the
contractor or its ability to complete its work.
The City has four options for consideration of award. The first option would be to reject
all bids. The second option would be to award the base bid only, and the third would be
to award the base bid plus the alternate. A fourth option would be to consider the award
of the Base Bid plus the alternate bid, and work with the low bidder to eliminate the
sidewalk and sheet piling in the area of Spring Creek. This option would provide a
sidewalk along County Road H for all but approximately 100 feet at Spring Creek. If the
Council does decide to award the project, we recommend the project be awarded to Ti-
Zack Concrete, Inc. in the amount of $149,877.50 for the Base Bid alone, and
$383,914.60 for the base bid plus alternate. Again, if the fourth option is the Council
preference, the Contract Amount would be reduced from the $383,914.60,by a Change
Order.
