RESOLUTION NO. 6355 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA ADJUSTING THE ASSESSMENT ROLE FOR THE 2003 STREET IMPROVEMENT PROJECT 7830 GLORIA CIRCLE DRIVEWAY APRON DELETION WHEREAS, as part of the 2003 Street Improvement Project, it was determined that there were a total of six (6) properties within the project area that had more than one driveway; and WHEREAS, on June 14,2004, the City Council held an assessment hearing and adopted a Special Assessment Levy for the 2003 Street Improvement Project; and WHEREAS, the properties that had one or more existing driveways were assessed a surcharge to cover the cost of an additional concrete driveway apron; and WHEREAS, the property owner of 7830 Gloria Circle requested that the second driveway access onto Hillview Road be removed and the assessment role revised to reflect the cost of the second driveway apron. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View, Ramsey County, Minnesota as follows: 1. Revises the plans of the 2003 Street Improvement Project by eliminating the second driveway apron located at: 7830 Gloria Circle PIN # 06-30-23-33-0012 owned by Ms. Barbara Matelsky. 2. Adjusts the assessment role for the 2003 Street Improvement by eliminating the cost of the second access for the aforementioned property, thus reducing the assessed amount assigned to said property from $3,364.27 to $2,475.59. 3. Exhibit A September 16, 2004 Ms. Barbara Mate/sky 7830 Gloria Circle Mounds View, MN 55112 Dear Ms. Matelsky; I am sending you this letter of understanding in an effort to address and document your wishes to alter the plan and assessment role for the 2003 Street Improvement Project. Based on our telephone conversation yesterday, you were informed that the City has an ordinance that allows for one curb cut per residential property. This ordinance was adopted on January 22, 1979. At this time, your property has two paved accesses; a horseshoe shaped driveway connecting Hillview Road to Gloria Circle, and one non-paved access; to an out building off of Hillview Road. Based on the aforementioned City Ordinance, a curb cut will not be allowed for access to the outbuilding located off of Hillview Road. It is my understanding that because the ordinance does not allowed this, you are now requesting that your existing paved access onto Hillview Road be eliminated as part of the 2003 Street Improvement Project. The City will remove the existing asphalt driveway onto Hillview Road by saw cutting at or near the property line and removing the asphalt from that point to the street. The City will add topsoil to this area and provide sod. A concrete barrier curb will be placed along the entire length of Hillview Road adjacent to your property. Staff will then present a proposed revision to the assessment role for the 2003 Street Improvement Project to the City Council to reduce your assessment by an amount equal to the total cost to provide a second concrete apron. The proposed revision will reduce the assessment of your property from the current amount of $3,364.27 to the proposed revised amount of $2,475.59 ($888.68 dollar reduction) . If you are agreeable to this, I ask that you sign the following statement: I, Babara Matelsky, being the property owner of 7830 Gloria Circle, request that the City to take the actions as outlined in this letter. It is anticipated that this will be presented to the City Council on September 27, 2004 for approval to revised the assessment role for the 2003 Street Improvement Project.
