RESOLUTION NO. 6366
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
ORDERING THE ABATEMENT OF HAZARDOUS CONDITIONS EXISTING AT 2617
SHERWOOD ROAD IN THE CITY OF MOUNDS VIEW
WHEREAS, the Housing Official of the City of Mounds View has determined that the
building at 2617 Sherwood Road in the City of Mounds View constitutes a hazardous building
within the meaning of Minnesota Statutes, Section 463.15, Subd. 3; and
WHEREAS, based on the investigations of the Housing Official and Building Official it is
recommended that hazardous conditions are abated or the hazardous building be razed and
removed; and
WHEREAS, Minnesota Statutes, Section 463.161 and Mounds View Housing
Maintenance Code Section 106.5 authorize the governing body of any City or town to correct or
remove the hazardous condition of any hazardous building or property.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Mounds View
as follows:
1.
The city of Mounds View finds that the building located at 2617 Sherwood Road
in the City of Mounds View legally described in the attached Abatement Order is
a hazardous building within the meaning of Minnesota Statutes, Section 463.15,
subd. 3, and Mounds View City Code Chapter 1005.
2. The hazardous building at the foregoing address also constitutes a public
nuisance within the meaning of Minnesota Statutes, Section 561.01, 562.01.
3. An Abatement Order substantially similar to that attached hereto as Exhibit "A"
shall be served upon all required parties in order to effectuate this resolution and
remove the hazardous building on the property.
4. The City Attorney is authorized to take all necessary legal steps to secure
compliance with the Order and to obtain authority to remove the hazardous
building by court order or consent and assess the costs thereof, against the
property.
