STATE OF MINNESOTA
RESOLUTION DENYING A CONDITIONAL USE PERMIT TO ALLOW FOR A
MOTOR FUEL STATION AT 2280 COUNTY ROAD I;
PLANNING CASE NO. CU2004-005
WHEREAS, Leon Theis and Tom Manke, owners of The Station, have
applied for a conditional use permit to operate a motor fuel station at 2280
County Road I, which is legally described as follows:
The East 134.72 Feet ofthe north 71.01 Feet of
Lot 1, Block 4, Spring Lake Park Highlands
Ramsey County, Minnesota
WHEREAS, the Mounds View Zoning Code conditionally allows motor
fuel station in the B-3, Highway Business District; and,
WHEREAS, the subject property is zoned B-2, limited Business District;
. and is currently improved with an operating fuel station named "The Station";,
WHEREAS, the Comprehensive Plan Future Land Use Map guides this
parcel as Neighborhood Commercial; and,
WHEREAS, the area of subject property is 9,583 square feet; and,
WHEREAS, the lot dimensions of 2280 County Road I are 134 x 71; and,
WHEREAS, the City Council has reviewed the following documents
regarding the proposal:
a. Development Application
b. Zoning Map
c. Location Map
d. Proposed Site Plan
e. Photographic documentation
f. Letter from Applicants
g. Staff Report
WHEREAS, the City Council held a duly noticed public hearing regarding
this request on Monday, November 22, 2004; and

WHEREAS, the Mounds View City Council makes the following findings of
fact related to this request.
1. The Station, located at 2280 County Road I, property zoned B-2,
Limited Business, is a considered legal, non-conforming use.
2. Motor fuel stations are not permitted in the B-2, Limited Business
District.
3. According to the Comprehensive Plan, Motor fuel stations are not
appropriate uses in areas designated "Neighborhood Commercia!."
4. The Station does not comply with the minimum lot area for a motor
fuel station - 22,500 square feet. The Station's area is only 9,583
square feet.
5. The Station does not comply with the minimum lot dimensions for a
motor fuel station - 150' x 130'. The Station's dimensions are 134'
x 71',
WHEREAS, the Mounds View Planning Commission, by its adoption of
Resolution 775-04, has recommended denial of the conditional use permit
request.
NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council,
based upon the above findings of fact and Planning Commission
recommendation, does hereby deny the conditional use permit request for The
Station, located at 2280 County Road I.
NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council
recognizes the right of "The Station" to continue operating at its present location
at 2280 County Road I as a legal non-conforming use.
