HomeMy WebLinkAboutOrdinance 899 ORDINANCE 899 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING TITLE 1100, CHAPTERS 1102 AND 1106 OF THE MOUNDS VIEW ZONING CODE TO ALLOW COLUMBARIA AT RELIGIOUS INSTITUTIONS; SPECIAL PLANNING CASE 193-15 The City of Mounds View ordains: SECTION 1. The City Council of the City of Mounds View hereby amends Title 1100, Chapter 1102.02 and Chapter 1106.03 of the Mounds View City Code by deleting the stricken language and adding the underlined text as follows: 1102.02: DEFINITIONS: The following words and terms, wherever they occur in this Code, shall be defined as follows: Subd. 17. COLUMBARIUM: A place for the usually public storage of urns holding a deceased's cremated remains. Columbaria can be either free standing units, or part of a mausoleum or another building. SECTION 2. The City Council of the City of Mounds View hereby amends Title 1100 Chapter 1106.03 of the Mounds View City Code pertaining to "Accessory Uses" by deleting the stricken language and adding the underlined text as follows: 1106.03: ACCESSORY USES: The following are permitted accessory uses in an R-1 District: Subd. 8. Columbarium as an accessory use to a religious institution; subject to the following conditions: (a) The religious institution must own the property on which the columbarium is placed. (b) The exterior of the columbaria must be solid stone, stainless steel or aluminum. (c) The combined square footage of all accessory buildings, including columbaria, shall not exceed 1,800 square feet. Ordinance 899 Page 2 (d) Columbaria shall only be placed in a side yard or rear yard area. (e) Columbaria shall have a minimum side yard and rear yard setback of five (5') feet. (f) Columbaria height shall not exceed eighteen (18') feet or that of the principal structure, whichever is less. (g) If the religious institution ceases operation, all urns and remains must be removed from the property within three (3) months. SECTION 3. In accordance with Section 3.07 of the City Charter, City staff shall have the following summary printed in the official City newspaper in lieu of the complete ordinance: On May 11, 2015, the City Council adopted Ordinance 899 that amends Chapters 1102 and 1106 of the Mounds View Municipal Code. These amendments will allow columbaria, which are structures designed to hold urns with a deceased's cremated remains, on properties owned by religious institutions. A printed copy of the ordinance is available for inspection during regular business hours at Mounds View City Hall and is available on line at the City's web site located at www.ci.mounds-view.mn.us. SECTION 4. This ordinance takes effect 30 days after its publication in the official City newspaper.
