RESOLtJTION APPROVING A MINOR SUBDIVISION OF THE PROPERTY
LOCATED AT 7841 SPRING LAKE ROAD; MOUNDS VIEW PLANNING CASE
NO. MIOI-002
WHEREAS, Brian Diehl has requested approval of a minor subdivision of 7841 Spring
Lake Road. zoned R-l, Single Family Residential. and legally-described as follows:

WHEREAS, the applicant has submitted a Certificate of Survey for the above described
property; and,
WHEREAS, the City Council has reviewed the following documents regarding this
proposal:

WHEREAS, the applicant proposes to split off the rear 260 feet of the property to create a
30,474 square foot buildable lot fronting unimproved Knollwood Drive and legally described as
shown on attached exhibit "A "; and,
WHEREAS, the applicant proposes to dedicate right-or-way to the City for the future

construction of a cul-de-sac as shown on attached exhibit "B'"; and,
WHEREAS. the City Council has reviewed the applicant's request for a minor
subdivision and has determined that it is in conformance with Chapters I 104. 1201, and 1202 of
the Municipal Code; and
WHEREAS, the City Council finds that the applicant's request for a minor subdivision is
in conformance with the Comprehcnsive Plan: and.
WHEREAS, thc Engineering Technician and Public Works Foreman for thc City of
Mounds View have rcviewed the proposed minor subdivision :md have found it acceptable: and,
WHEREAS, the Planning Commission reviewed this request on November 7,
2001. and recommended approval of the minor subdivision: and,
WHEREAS, in accordance with Section 1204.04, Subd. 4, a park dedication fee in the
amount of $2,346 is applicable with this proposed minor subdivision; and,
NOW, THEREFORE, BE IT RESOLVED, having found that the proposed subdivision
satisties City subdivision and zoning requirements and is in conformance with the
Comprehensive Plan, thc Mounds View City Council approves the minor subdivision of 7841
Spring Lake Road requcsted by Brian Diehl, subject to thc following:
1. Prior to thc City affixing its signatures to the Resolution of approvaL the applicant
shall submit the required park dedication fee in the amount of $2,346.
2. The applicant shall be responsible for relocating the restricted access gates on
unimproved Knollwood Drive north an appropriate distancc to allow sul1icient
setback from the proposed driveway.
3. If the cul-de-sac is rcquired to be improved as a result of any future subdivision, thc
applicant shall be responsible for a proportionate share of the construction costs.
4. The applicant shall record the City Council resolution of approvaL the Ccrtiticate of
Survey, the parcel .'^" easement document, the parcel "B" eascment document. and
the right-of-way dedication document with Ramsey County within sixty (60) days of
final adoption, and present proof of such recording to the City of Mounds View.
failure to record these documents or provide proof of such recordation shall cause
this approval to be null and void.

5. The City Attorney shall review and approve the property Title prior to
recording the resolution of approval.
